It's the collections company acting on the DWP behalf, but ultimately its the DWP .HillStreetBlues said:
Yes benefits and even wages, so at some point if the DWP keep chasing they will get the money, That's how the letter should read, giving actions they can lawfully take, not actions that they lawfully can not take.calcotti said:If nothing else has happened in the meantime DWP can recover any debt by deductions from the State Pension when it is put into payment.

If you doubt the letter is legit. Google HMRC and use the telephone number from google rather than what’s on the letter (they may be the same)TM74 said:

As pointed out above, even if you never claim any benefits, they will eventually have it back out of your state pension. It is up to you to prove you have repaid the debt in full. Unfortunately DWP don't really care if you agree or not.

No problem. I was mainly trying to find out if the amount the DWP are now chasing is less than what you were originally overpaid. In other words, does it reflect that fact that you had made some repayments at some point in the past.TM74 said:
I'd rather not post that info on a public forum .Robbie64 said:Also, how much was the original debt and how much are the DWP stating you still owe?

If you haven't made a payment within the last 6 year the letter you received threatening court is classed as harassment.TM74 said:

As I said previously write a "cease and desist" letter to the collection company telling them further letters of this nature you will be reporting as harassment.
This should at least get the collection company off your back

making you think action can be taken that is not legally possible.

Thanks to all who offered advice, I've spoken to DWP and they agree there must be some sort of mistake, they can't seem to find out anything in the system but have said if it's still outstanding chances are it's still owed. They will be investigating further but they also seem baffled by it.2
