Letter of Claim from DCB Legal - PCN dated 2019

  • So, I have sent the response to DCB Legal
    This was within the timeframe they specified
    I clearly stated I expected a response
    So far I have no reply

    Is this their normal approach?
    Is it now a waiting game for the court case to arrive?
    Should I chase up a reply from them?

  • You only sent it last week!  No idea why a response is expected already?  It'll be March.
    Is the address I have mailed correct?
    This is the only one I could find.

    I expected acknowledgment of my mail. Not necessarily an answer to my questions.
    Based on your March comment, would I be right in assuming they now have 30 days once the ball is back in their court?

    This was just to fire a shot and set out the areas of dispute, showing you are not a pushover.

    It matters in as much as I want it done and dusted.
    I've got other things going on, and this is a looming 'something' I could do without. 

    I'll just have to assume the mail address I have sent to is correct, and the shot I fired has hit the target.

    If the email didn't bounce back to you as undeliverable, then technically, it has been delivered. What you don't know is if their mailbox "info" is monitored. If you didn't get a bounce back and they don't have a valid "info" mailbox then it will most likely have been delivered into a catchall mailbox. Either way, your email has been delivered.

    You have a copy of the email in your "sent" mailbox which is all you need. Just like you are advised never to use "Recorded Delivery" snail mail, only use "Proof of Posting" from a post office, your copy of the sent email is your "proof of posting".

    You could really make their life miserable by requesting an SAR from them and if they do not include in their response, a copy of the email you sent (as long as you did not receive a bounce back response) you should immediately report them to the ICO as they have not provided information which is somewhere in their system. Usually proves an incompetent and/or inept person in charge of their IT. Not uncommon at all, especially with the "fur coat and no knickers" scammers or solicitors who try to appear as though they are big corporate firms rather than the little back office types with just a few dregs from their industry working for them.

    Someone advised me there is not much point in making an SAR to DCBLegal.
    I searched and searched for a more direct mail for DCBLegal, both on the web in general and here in MSF, but kept coming up blank

    Seeing as I'm in for a wait, I may well make an SAR to them. If for no other reason than making them work

    The only reason I suggested you SAR DCB Legal is if they claim they never received your email which you addressed as "info@dcblegal.co.uk". However, there is nothing to prevent you from doing so anyway, even if it is only to confirm that they have received unacknowledged emails from you.
