  • Hello, so I've just received the following email 

    We act for the Claimant. 

    Please find enclosed, by way of service, the Claimants Witness Statement.

    The Claimant, without intending any discourtesy, hereby gives notice that it will not be attending the final hearing.

    This notice is given pursuant to CPR 27.9.

    The Court has been notified of the Claimant's non-attendance and have been asked to deal with the Claim in the Claimant's absence.

    We confirm the statement has been filed with the court.

    ......

    What does this mean ?

    What does this mean ?
     
    It means...
    1. Whoever sent you that email is working for the Claimant.
    2. They've sent you a copy of the Claimant's Witness Statement.
    3. The Claimant will not attend the hearing.
    4. I'll leave you to google CPR 27.9 if you are interested but it's not very exciting.
    5. They've notified the court of the Claimant's non-attendance and have asked the court to deal with the Claim in the Claimant's absence.
    6. They have sent a copy of the letter you have received to the court.
  • I get that, is it normal practice that this happens ? And why would they do that? 

    Also should I send my WS to the courts now or wait 7 days before the court date ?

    Yes that is normal. All as explained already in the resources here.  You need to go back to the second post in the NEWBIES thread 

    I doubt your hearing order says only 7 days before?!  You'll be late if you do that.

    Where did you get the '7 days' idea from?

    That Notice you showed us a couple of weeks ago clearly states...
    Those 'documents' are your Witness Statement and evidence.

    Court day today (11/04/24) @ 10am

    No show from Claimant 

    Case dismissed in 5 mins

    Reasoning, vehicle parked in left bay was in my bay.

    Its not safe for me to park within my bay as it was a safety issue due not being able to fully open the door.

    The space to the right of my vehicle is not a parking bay so does not hinder or cause any issue with anyone else
