    You should/might/will receive a letter before/of claim followed by a N1 claim form, all as outlined in the NEWBIE sticky.

    ok, I have recieved the N1, have completed the AOS and currently drafting my defence

    Here is what have so far

    The ticket was for residential parking in my own bay. For having the vehicle outside the line.

    The facts as known to the Defendant:

    2. It is admitted that the Defendant was the registered keeper of the vehicle.

    3. The defendant resides at Defendant Address. As the owner of the property, the defendant also owns a parking spot, this was allocated when the property was first purchased back in 2018. The defendant, has a parking permit, that allows them to park in bay 27, and this is always on show when parking in bay within the windscreen of vehicle. The defendant has parked within this bay since 2018 and has had no issues with parking attendants handing out tickets.

    The issue with this area, is that the property is located next to the shopping centre. Shoppers decide to park in the parking bays that are allocated to the owners of Defendants Address.

    The defendant was abroad on the 11/08/2022, before this the defendant was having issues with parking as they had returned home to find the bay was being used by a shopper, that had parked over two bays. The defendant, still managed to park within their bay with their permit showing.

    What is the Issue Date on your County Court Claim Form?

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    With a Claim Issue Date of 11th July, and having filed an Acknowledgment of Service on 14th July, you have until 4pm on Friday 11th August 2023 to file your Defence.

    That's four weeks away. Plenty of time to produce a Defence, but please don't leave the preparation of it to the last minute. However, you should leave the filing of it as late as possible.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Looks fine.  This is easier than you think, isn't it, with the template defence?  

    HOWEVER:

    There is now good reason to delay defence submission till close to/at your deadline (as long as you've done the AOS), Sorry if it might look conflicting with the usual advice "not to leave it till the last minute"!

    It's because we are now in July and something big is coming.

    Things are changing quickly this Summer and as you are now so close to the DLUHC's Announcement (the Government's opinion about rip-off private parking 'debt' fees, etc).  I would PREPARE the defence but hold off emailing it, wait and see (and of course diarise an alert for the date so you don't actually miss your deadline).

    Your timing is perfect if the DLUHC in their Draft Impact Assessment - due any week now - give us all some damning words to add!  Come back and see in a couple of weeks.
