ECP DCB Legal default CCJ - Claims form not received, seems to be CNBC error
Comments
-
My take on this maladministration by the CNBC is that they should use their case management powers to set it aside free of charge and proceed with the claim in the standard manner, a reset if you will
Otherwise justice isn't served
Their f u bar, it's up to them to make it right, same as in all the other recent f u bars they have made in the last 6 months ( of which there are several problems within their case management system )
So I would not be paying, I would be fighting for justice2 -
How do i do it pls, just now I spoke to the CNBC helpdesk and the only way to take it forward is to fill N244 form, no other way. There is no process to set it aside free of chargeGr1pr said:My take on this maladministration by the CNBC is that they should use their case management powers to set it aside free of charge and proceed with the claim in the standard manner, a reset if you will

You should be doing what doubledotcom is doing in the thread I linked, plus what I said earlierBirkum said:
Thank you Gr1pr, i have read most of the recent default judgement and personally dont see other option but to pay. Because if the case need to be set aside then there is almost £300 fees which is almost same as what i need to pay, While i want to fight and that is the reason did everything so far but this seem to not make sense to me anymore. I am gutted that the system works this way, have not received any claim forms etc as i was very careful with posts knowing this is going on, and now in this situation.Gr1pr said:There have been quite a lot of these default judgments recently, possibly a failure at the CNBC ?
I strongly suggest that you study other recent default Judgment cases within the last 2 months and check the advice given in them
On a side note , FYI , Coupon-mad is on holiday, but you should check her posts on here, plus a few other replies by other knowledgeable members
A complaint to your local MP is also a good idea, as well as a written complaint to hmcourts too
Study threads and replies by doubkedotcom too, such as the CNBC LOSING THE PLOT case

Ps , change your thread title to something more suitable like
ECP DCB Legal default CCJ due to CNBC error
Nobody mentioned phoning the CNBC, they only give the standard template reply to you, which I already knew would happen, so I deliberately didn't mention it
You should complain in writing by email to HMCTS
You should complain in writing by email to your local MP , to get them to contact the Justice Minister
You should be gathering evidence of all the other similar cases caused by their mismanagement
You should be gathering evidence of malpractice by the CNBC in Northampton
You should be doing anything and everything to get the CCJ set aside at nil cost ( not by paying the standard default fee of £313 )
You should edit your thread title as I suggested earlier too2 -
thank you Gr1pr, complain to HMCTS in progress and also list of similar cases. Taking guidance from doubledotcome.
Thank you2 -
Let us know what HMCTS says. They are quite quick to handle complaints.Birkum said:thank you Gr1pr, complain to HMCTS in progress and also list of similar cases. Taking guidance from doubledotcome.
Thank youPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Update- HMCTS has said that I have to use the set aside process. We have escalated to the next level. My MP has been very helpful and today he has written to the Ministry of Justice (Shabana Mahmood) and separately to Chief Exec of HMCTS raising the point. I have till 18th of July (30 days) only to make a decision on the next steps.1
