    Is this the same friend who was wanting advance payments on their benefits? Same suggestion as before, she needs to sort her finances out.

  • Is it during the fixed term period? If not, the landlord could always serve a s21 notice or wait and do it if the relationship has broken down. 

    Shouting is never a good approach for trying to win someone round when they are ultimately in a position of strength.

  • I think your friend needs to look at their choices. Not paying any rent apart from the first payment but apparently having the money in the bank to do so is disgusting behaviour and was only going to end one way. 

    I imagine they have been called and chased countless times as landlords don't just pay for court proceedings for fun.

    I think your friend needs to look at their choices. Not paying any rent apart from the first payment but apparently having the money in the bank to do so is disgusting behaviour and was only going to end one way. 

    I imagine they have been called and chased countless times as landlords don't just pay for court proceedings for fun.
    The OP has stated that bank account was frozen due to fraud.  Understandable excuse for some delay but not for two months.
    Landlord has not yet paid for court proceedings they have just sent a notice.

    Exactly that. Fraud fine, but not for two months and it doesn't seem like the account is blocked now? They appear to be able to pay right away. It seems like the landlord also doesn't believe this story and they are in a better position to know more on what has happened.

    The landlord might have paid a lawyer to issue it so it could have come at a cost. I'm just saying, if they had been there 3 years and then this happened, fine, they deserve some leniency as they would likely have a good track record of payment, but after 2 months I personally would be doing exactly what this landlord is and would probably continue to eviction unless all the arrears were cleared and every rent payment was faultless from now on.

    While it might be unusual there are examples on the Banking board of people whose accounts have been frozen for longer than 2 months while investigations are carried out - it really depends on whether the bank considers that the account holder is complicit in the fraud or not, and whether the police are involved. What it does indicate is the foolisheness of relying on a single account to hold all your money.
    To answer the original question, moving out may be the best option, as other posts have suggested the current LL is unlikely to be happy to keep a tenant such as this even if their current attempts to regain the property are unsuccessful.

    It night make sense to advise the landlord before defaulting on rent that there is an issue. Also paying the money off first then advising them arrears have been settled.
    This early in a relationship, trust has not been built so the landlord is probably thinking they have a freeloader out to screw them over (as they have little other information indicating otherwise).
    Also, people become suspicious about those making a big song and dance about how they will shortly be paying off a debt, (again it sounds like stalling tactics), paying money and saying 'I've just sent £x to cover my arrears' presents an individual who had an issue but is fixing it now.
