This is my defence so far lol 2 On the day of the alleged contravention, the driver of the van was in the retail park for the purpose of loading materials for a job he was working on. He was simply completing his job duties, and had no intention of committing any offences. 3. The defendant would like to respectfully defend themselves against the parking fine that was issued to them. It is important to note that this offence was alleged to have occurred over 5 years ago. The defendant cannot be certain of who was driving the van at the time of the alleged offence as the vehicle is a work van, they may not have been the person behind the wheel at the time in question and it is possible that whoever was in fact driving was in the process of loading, not parking.0

2. It is admitted that the Defendant was the registered keeper and driver of the vehicle in question.
3. The Defendant’s vehicle was briefly left unattended whilst being loaded - not parked - in the area in question for approximately 5 minutes. The vehicle was only very briefly left unattended in an unobstructive position whilst loading work materials which further justifies the 5 minute unloading/loading process.
4. The Defendant quotes the judgements on the Laura Jopson vs Homeguard Services case [2016] B9GF0A9E as a supporting ruling where the Judge found that people unloading / making deliveries are not in breach of the so-called parking contract.
5. The 5 minute duration of the unloading process would fall under a grace period agreed by the landowner. No evidence of the grace period has been shown by the Claimant.
6. The Claimant's ‘contract’ is written on a handful of extremely small, hard-to-read signs placed out of eye-line and in some cases concealed by walls and foliage, and not placed in areas where one would notice them. The text is so small that one could only read it from a couple of metres away. The driver did not see these at all during their brief time in the area, nor was the resident of the building aware of them despite living there for many months
So would this we ok? and would I replace points 2-6 in the template with this or only insert it into section 2-3? apologies but i find all this type of stuff quite confusing

Im sorry but I dont understand what does treat MCOL as read only mean?
Also can i file my defence online and does this mean I do it directly to County court business centre not MCOL?

Do NOT try to file your defence on MCOL, please follow the advice already given to you and send your defence by e-mail to CCBC. Treat MCOL as READ only means you just read it, you do not interact with it and you certainly do not put anything in the defence box!2
