Completely agree.JIL said: It's a ridiculous situation that a date of birth is held on a benefits payment system (UC) and that system allows an overpayment to happen, and because there aren't supposed to be any UC overpayments its recoverable.
Add in the death of a husband for this to come to light, along with the fact that another state benefit should/could have been paid. It's a terrible situation for the individual to sort out.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -

I am in true shock of this system. A system that should be there for the vulnerable.I'm a little confused as to why you are saying your mother is vunerable as you said you and your parents come from another country. The UK doesn't have chain migration, where migrants can bring all their family to the UK. Under UK immigration rules, only a family member who is a partner and their children (under age 18) are allowed to move to the UK. There are other routes for a few elderly, but as their adult children are in the UK too, I assume they didn't use that route? However, the EU allowed chain migation for all the family members of the EEA citizen; and all the family members of their non-EEA citizen partner; IF they proved all of that family were financially dependent on the EEA citizen.Did your parents come to the UK under the EU routes? If they did, what happened to the support from their EEA citizen sponsor?
