    Remember you can use your previous case to immediately apply for a strike out in the first paragraph of your defence.

    CPR 3.4.(2)(c):

    Power to strike out a statement of case
    3.4
    (2) The court may strike out a statement of case if it appears to the court—

    (a) that the statement of case discloses no reasonable grounds for bringing the claim;


    State it should be struck out because it's the exact same claimant, exact same location, exact same contract and that the case was dismissed at a hearing on xx date at xyz court.

    Change of solicitor makes no difference.
