Items 8, 9 and 10 on that checklist you were following when you filed a Defence describe exactly how you can file and serve a DQ by email.

Thank you for your response. Can the form be emailed to them or does it need to be printed ?

See @KeithP's post immediately before yours. Probably crossed in posting.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hello everyone, the time has come ( perfect timing being just before christmas ) where i have to go to court to fight for my rights at a residential estate against these criminal parking companies. My court date is 19th December and i need to file my evidence ( witness statement included ) before the 28th December. The claimant has until the 22nd to pay the court fee and file their evidence. I have pretty much got all my evidence together but i am currently writing my witness statement. Does anyone have any links to previous example statements i can use for reference please. Much appreciated.

Sorry, that doesn't make a lot of sense.

You tell us your court date is 19th December, then any evidence should have been filed with the court and served on the Claimant weeks ago.

Likewise with the hearing fee - should've been paid by the Claimantlong ago.

"I am currently writing my witness statement" - you're kidding surely - for a hearing tomorrow??
  • Could someone also inform me if i am able to submit my evidence via email. ( presume i can ) Cannot see anywhere stating where the email needs to be sent.

I do apologise Keith, i should have proof red what i said. The court date is on the 19 January 2024, not December.

Just do the WS bundle by email to the local court and solicitors, this week.  Get it done and they might discontinue.  You never get told if they paid the fee or not.

See NEWBIES thread for WS bundle examples to adapt easily.

  • Thank you.  They have until the 22nd to pay the fee, or it will be thrown out. Have i've been looking through the NEWBIES thread to find example witness statements and also gathering photo evidence. Right so it needs to be the local court i email it to. as all other correspondence has been with Northampton county court.

Obviously nothing goes to Northampton!  You nominated your court months ago.  And of course you have to copy in the C's solucitors.
