I did not post in here that I received the claim form because I sent off the acknowledgment of service and thought I had all of the advise I needed by reading other threads on this site.
That of course is fine - to be applauded even.   :)

Hi, I have recieved another letter of claim for another PCN for the same car park on a different occasion. I sent the SAR back in January and have not heard anything back from UKPC.
So (as above) you had two cases on the go and one of them has had a claim form issued and you've got a default judgment.

I presume they used an old address?

You didn't fail to defend a claim?

Due to the amount of that CCJ you must URGENTLY (unless this is your failure to defend):

    1.  Ring the CCBC in the morning and ask:

i). what address the claim form was sent to, and

ii). for a copy of the Particulars of Claim to be emailed to you while you are on the phone, and

iii). which email address to use to send an urgent application to stay the writ and how to pay the £12 fee.

    2.  Then apply to STAY THE WRIT.  Do not hang about!  You must do this to prevent a visit from HCEOs at your house.  This is serious.

Costs £12 (paid to the CCBC) to apply to stay a writ.

Do that immediately, tomorrow morning, with a N244 stating that you are applying to:

    (a) stay the writ

    (b) have the CCJ set aside because you were at all times in contact with UKPC and DCBLegal about threats of court, and they knew how to contact you, and yet they appear to have filed a claim to an old address because no claim form was served*.  Attach proof of DCBLegal's email saying the case was 'on hold' and only at pre-action stage, and any proof that you told them or UKPC your new address.

In BOTH CASES did you tell UKPC or DCBLegal (or both), weeks/months ago, to erase your old address and rectify it to your new one?

    * EDIT:

ARE YOU SAYING YOU RECEIVED BUT DIDN'T DEFEND A COURT CLAIM?

  • I sent the acknowledgement of service and my defence is ready to be sent, in line with the 28 day timeframe.

It isn't.  You are far too late.

You got a claim dated December that needed a defence by the first week in February.  You are out of time. You never said you had a court claim!

I am so sorry.  You could try applying to stay the writ as it only cost £12 and hope you get lucky.

Hi, I have recieved another letter of claim for another PCN for the same car park on a different occasion. I sent the SAR back in January and have not heard anything back from UKPC. I have re-sent the same email to DCB legal including the new reference number. Is there anything else I should do?
On 22nd Feb you wrote the above. What do you mean by "I have re-sent the same email to DCB legal including the new reference number."? Was that second "another" LoC sent to the correct address or the old one which you'd already told them to erase?

How  many N1 claim forms did you receive 1 or 2, you’ve stated you received one on the 28th Dec, was there a second?

Thank you for the above. How do I apply to stay the writ?

But what will be your grounds?

Why did you think mid-March was still OK to defend a December claim?

  • I did not realise I needed to file a defence to a letter of claim. I deeply regret it.

    You didn't.

We are asking if you received a N1 CLAIM FORM?
