AOS done - i have 2 weeks for defence but confused about steps - pls advise

    Regarding the hearing when i send documents to court and VCS - docs will include witness statement, my defence statement , some pictures which are better quality than VCS presented - apart from that am i allow to introduce my final statement which binds everything together or this is not needed or allowed as it will happen during the court telephone hearing?

    I am really confused. Have you written your WS based on more recent examples by @aphex007 and @SJRRJS including exhibits. pictures etc?

    What do you mean by introducing a final statement?

  • Witness statement is as per court papers and i am not worried about that.
    By final statement i mean do i need to say anything on paper before the hearing or there is no need / i am not allowed to untill the hearing?

    I still think you are muddling up defence with witness statement.

    They are two separate documents and yes, the latter (a statement in the first person) gets sent with a bundle now.  The defence does not.

    Which is why we keep signposting you to read examples done already, that you must copy and adapt.

    Please go read their threads, then I think you will get what we mean.

    You would also benefit from re-reading the NEWBIES thread section under the RED CAPITALS heading 'IMPORTANT: KNOW WHAT HAPPENS WHEN'.

    As CM says you seem to think your defence is your WS.

    It isn't, it is an entirely different document used to back up your defence. Read the examples linked above and it should become clearer.

    I have telephone hearing by small court - any final advice you could give me please?
    What is say and what to avoid? In any case the truth and whole truth. Is there appeal possible- i would possibly give up as not willing to invest any more time into this. Will let you know anyway how it went.

    Read and know your defence and witness statement inside out, make yourself a crib sheet so that, if you are given a chance by the judge to talk, you can make sure you get across ALL your points.  Dress as if you were going to the office, wear shoes, not slippers and, sometimes, it helps to take the phone call standing up - but that's just me!  Make sure the court has your phone number and follow any instructions for "joining" as closely as possible.  Be there early in case the cases in front of you move up the queue.  Be polite and do not talk over the judge and finally, as @Mouse007 states - good luck.
