Sadly SAR request link is no longer valid from newbies thread - i cannot post direct link because i am new to forum.
I did register at legalbeagles but it did not help.
Is there a chance somebody please share it with me or upload to the forum ?
Does look as though the link is broken - whether that's temporary or permanent, hard to tell. As an alternative, the ICO offers a suggested format ...

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

• hi
I just sent SAR to VCS but got automatic reply that they will take 28 days to process which is obviously too long for me (i have 3 weeks left to send defence).

If they don't reply is it really to my detriment? I have copies of the pictures of my car (downloaded from their website) but i dont have copy of my appeal which was sent using their website.

Shall i wait for SAR reply and send my defence only few days before deadline or whenever it is ready?
Regards
• this is automatic reply from VCS:

As you say, an automated response.

Like everyone else, they have a month to respond to a SAR.

The SAR response will be far more useful at Witness Statement time anyway.

No-one was saying the SAR has to come back before your defence. It's useful at later stages.

i am preparing documentation for the email to send to CCBC (my permit expired and the valid one was behind expired one). I know that i will have to fill sections 2 and 3 but apart from that can i attach to the email 2 pdf documents?
1 First document from my employer confirming that i work for them and i was allowed to park in the bay where ticket was given - i already have that ready
2 I need to ask my colleague to give me evidence - he saw traffic wardens coming to the car park which prompted me to check my car. I walked past traffic wardens and there was no parking ticket on my windshield. When i came back to office i did say to him i had no ticket. However few days later ticket arrived with some paper on the windshield which they must have removed after taking picture - very honest indeed :)
My question is - what tense shall i use when writing this statement - should it be written by my college eg. "I saw..." and then signed by him? Does it have to be hand written or is it enough to print it out sign and scan again and add his mobile number?

Thanks a lot for help - i would have given up already without your guidance.

That (attaching evidence and witness statements) doesn't come until later: witness statement stage.

See second post of the NEWBIES thread, under the RED CAPITALS heading IMPORTANT: KNOW WHAT HAPPENS WHEN.

Nope but we do like to check everyone's added facts paragraphs, if you haven't shown those already here.

Please please check my version to be filled in as paragraph 2 and 3 - any comments more than welcome.
Please correct my pigeon English as it is my second language. I have 3 paragraphs in section 3 - shall i give each paragraph separate number ? 3,4,5?

2. It is admitted that the Defendant was the registered keeper of the vehicle in question.

3. Defendant parked properly in the allocated space as allowed by the company that employs defendant. Defendant was given by his company a letter confirming employment and the right to park in the allocated space which can be presented later to the court.

On the day when PCN ticket was given, colleague of the defendant saw through the office window, traffic wardens checking the cars on the car park. This prompted defendant to check his own car - which had 2 permits – one which has expired and the second permit which was valid but was obscured by the expired one. After correcting the permit, checking the windshield and not noticing any ticket given defendant returned to his work office and told colleague that no parking ticket was received (Collegue can confirm this). However, several days later PCN ticket arrived with pictures showing a loose paper placed on the windshield which must have been removed after taking the picture. During checking his permit defendant was walking very near traffic wardens which could have prompted him to explain the situation which would have been resolved at the time.

Defendant appealed against PCN ticket explaining his right to park there but his appeal was dismissed.
