    That defence should have added that the Claimant is aware of this fact because the Defendant appealed at the time, and so there is no cause of action.  Never mind, that could be added at WS stage if it gets that far.

    The case will almost certainly be discontinued anyway, given that Highview is the claimant, using DCB legal.

    just received notice of transfer of proceedings

    "the claim has been transferred to the below county court hearing center for allocation. on receipt the file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judge's direction will be sent to you in a notice of allocation."

    seems like this may actually end up going to court.

    Just recieved the Notice of Allocation to the Small Claims Track (Hearing) N157

    no date set yet it seems though? Assuming its now time to start preppin g the witness statement?

    Are you sure no date has been set?
    You could be right, but I suggest you read that Notice carefully again.

    Also, is there a paragraph something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    Might be on the back.
    Those 'documents on which you intend to rely' are your Witness Statement and evidence.

    "2) the claim will be heard at xxxxxx. on a date and a time which will be sent to you later. the court reserves the right to change the place and/or time of the hearing.

    just recieved the notice of trial date. 

    It's set for 6th October.

    Says something about a trial fee of 27.00 that the claimant needs to pay before 8th sept else it will be struck out. 

    When does my witness statement need to be sent? 22nd sept? looks like it may go the full way.

    "Trial"? Really? If you've followed all the advice given here about DCB Legal issued claims you would know by now that it is most likely to be discontinued before it ever gets in front of a judge, jury, barristers and all those ushers you seem to be imagining in your head.  >:)
