    letter through the post from HM Courts & Tribunals 

    "I acknowledge receipt of your defence. A copy is being served on the claimant (or the claimant's solictor). The claimant may contact you direct to attempt to resolve any dispute. If the dispute cannot be resolved infromally, the claimant will inform the court that he wishes to proceed. The county will then inform you of what will happen

    Where he wishes to proceed, the claimant must contact the court within 28 days after recieving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay"

    Does this sound right? Next steps are as per newbie thing? I haven't recived that N180 form or anything yet.

    Have received a letter stating

    "having reviewed the content of your Defense, we are writing to inform you that our Client intends to proceed with the claim.
    The Court will direct both parties to file directions questionnaires in due course. In anticipation of that we are enclosing a copy.

    Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. Therefore, in the event you wish to discuss settlement, please call us on XXXXXXX within 7 days and make immediate reference to this correspondence. "

    annoyingly she rang up to discuss settlement figure, which worked out 1/2 the value of the claim. She decided not to settle.

    Will this harm the process?

    No. However, "she" needs educating why funding these scammers is not worthwhile. Explain to "her" why does she think they are prepared to settle for half if they have such a surefire case?

    Now you can expect the inevitable discontinuation. Tell "her" to read this thread:

    Why did she do that, when that exact letter is covered in the first 12 steps in the Template Defence thread?  Did the D forget all about the first 12 steps and advice here?

    Please can you stop the D going off-piste? I am sure the D wants to win this case and see it discontinued without a hearing, which is what our way achieves.

    agreed - its the fright response from these scammers. 

    How can we check if they have gone ahead to proceed? we haven't received a questionnaire or any letters from the court yet. How can we check it hasn't been lost in the post or something?

    You could check MCOL or ring the CCBC.

    Or just wait. Do not let that victim panic again!  This will be discontinued and all over this year, if they play it right.
