  • Afternoon all,
    Just Received this from them.
Is it just awaiting the letter from the courts now.
It’s funny to notice how they’ve added a “without prejudice part” is this so they can potentially use it to avoid court in the hope I’ll ring them to settle before that point?

    Thanks
Seen that "without prejudice" wheeze many times and the bit about assisting the court ?

    The
only assistance DCBL DO TO ASSIST THE COURT IS DISCONTINUE which saves the court another timewasting case which no doubt the judges are getting bored with by now

Simple to understand, they don't want to go to court

  • Absolutely loved that post, and has instilled a fresh fight with myself. (After my S.O nagging me to settle before court).
I will wait for the court letter and will fill it in as the other post shows!
    Thanks for the help guys!
  • Good evening guys,

Just looked on the MCOL website.

It states I filed my DQ on 16 of this month which was wrong I filed it on 06/02.

It’s also states it’s now been transferred to (my local (ish) county court)  on the same date (16/03/23).

    Is this standard?

Or does this only happen when they’re intending to fight it? Or do I still have the possibility of it being discontinued?

I still haven’t been sent a letter from either since filing my N180.

    Cheers

If you're a betting person, you should put money on it being discontinued before it ever gets to court.
  • Good evening guys, haven’t posted sooner as been mega busy (new born came early).

I’ve got the court paperwork through and it’s the 3rd week in June ( staying ambiguous in case they follow the forums)

any advice on writing defence etc? Got 11 days to submit it. (Received letter 6 days ago)

I’ve got pictures of signage etc. a video driving in to the area to show lack of visual signage.
Also got a map the claimant sent me showing my car with an “X” just outside the lined area showing which land they enforce. (Did send this in the original appeal) the signage pics and videos are extras.

    Thanks

    Yes, too ambiguous.
    Court paperwork? What court paperwork?
It's 3rd week of June? No it's not, it's the second week of May.

Reading on, I guess you have received a County Court Claim Form.
If you want further help can I suggest you tell us the Issue Date on your Claim Form?
Don't worry about giving yourself away by telling us that date. How many County Court Claims for parking do you imagine are issued every day? It's hundreds - if not thousands.

    Hey Keith,

Apologies I should’ve specified it’s the allocation date for the 15 June for the small claims court. I’ve got a 1 hour slot

also, thanks for the swift response

You still haven't answered @KeithP's most important question.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
