DCB Legal - CCJ

Good evening, 
just after some advice really. 
I’ve received a court letter from the above firm due to a parking offence on private land outside of Cardiff. I initially appealed the process but the governing body agreed with the parking firm (who would’ve guessed) even though their own diagram showed my car outside of the boundaries they enforce. 

Long story short myself and my ex split up causing myself to effectively become homeless. (Bouncing between sofas and hotels with work) 
their company was sending letters as well as DCBL to my ex partners house. 
I asked them to stop this as I no longer lived there. Going off what my ex partner has said the letters stopped. (They have my email and phone number to converse) 

Today I get a phone call from my father that a letter has arrived at his house for me. So I go round to collect it. 
I open it to find a county court claim for nearly £270. Original fine being £100. on the court documents it states £160. Judging off of others posts on here I’m assuming that would mean DCBL have added £60. 

Is there any advice anyone could kindly offer. As I’m genuinely worried about this especially so close to Christmas. And only have 14 days to respond to this court letter (dated 29-11-22)

    Breakdown of costs shows £173.32 amount claimed 
    court fee of £35 and a legal representative cost of £50 totalling £258.32

    Date of Issue shown on the court claim form please?

    Have you submitted your Acknowledgement of Service (AOS) of the claim, and if so, on what date? 

    Name of the parking firm involved please?

    I thought I'd draw your attention to this fairly recent thread which you might have not yet seen. You must keep going through all the necessary court procedure phases, but the hope is that your case will follow the same pattern as all those detailed in the thread. 

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Date of issue is 29 Nov 2022

    I have not submitted the AOS as of yet, as I’ve only just got the letter from my fathers property. Unsure how or why they’ve sent it there. Could be because I was once registered there. 

    The parking firm involved are NGP Ltd.

    I have not submitted the AOS as of yet...

    With a Claim Issue Date of 29th November, you have until Monday 19th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 3rd January 2023 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    You must also email a utility bill or tenancy proof from your new address to the CCBC and DCBLegal and tell both that a defence will be filed shortly but they (court service and claimant's legal rep) must immediately update this claim to show your new address (assuming it would be better for you, for all court directions & hearing date letters in 2023 not to go to your parents' address as you could miss a deadline?).

    If you still own that car, is the V5C address now correct? Needs to be.

    I still do not have a fixed abode but have asked my father to notify myself as soon as any letters come through going forward.

    Why did your Fleet Dept at work give out your old address (when they were sent the PCN initially), and do they still only hold your old address?  I may be worrying about nothing but this could happen again, if your Fleet Dept don't have your up to date address.

    We will help you defend this - that bit is easy - but there will be more forms and stages and only 14 days to respond to some.  Make sure you don't delay seeing each letter.

    I was still living with my partner at the time of the initial PCN, that’s the address they gave. (They have my fathers address now as I do sometimes stay there when not away with work). 

    My father is aware and has stated he will call me on receipt of any letters for myself. (Doesn’t help currently with all the Royal Mail strikes delaying deliveries). 

    Appreciate the insight honestly! Want to cover all bases so something like this doesn’t get to this point again!

    The original PCN was from December of last year (Forgot to add this point)
