If I had to choose whether to follow advice from couponmad or from diystarter, I’m fairly sure I know which one it would be.All shall be well, and all shall be well, and all manner of things shall be well.

Hi OP
To be clear, what are the 'unloading' rules, please?
IMO, if you cite those and the rules allow you to unload in the pedestrian area, then you have won.
You have your dash cam as evidnece you was taking out stuff and you was back in seconds,
How do people leaving or moving into the estate take in their tv, fridge, washing machine, sofa, bed, wardrobes etc etc - do they all get a ticket when they park next to their door? Or do they walk with the stuff from the underground car park?
Many thanks.
PS: As per your thread title re "5 mins grace management said.." - Why are they fining you after 2 mins when they allow you 5 mins to unload on the pedestrian area?
I am genuinely confused. Thanks0 -
You have a most excellent case in my opinion, and I believe the PCN was issued under false pretences.
I suggest you complain to the landowner, the managing agent, your MP, the PPC, the IPC, the DVLA, and your MP that Link have unlawfully obtained and processed your data, and the DVLA unlawfully sold your data. Add to your complaint that Link are using a prohibited premium rate 'phone number.
You could try an IAS appeal as long as it is the free to use version that is not binding on the motorist if you lose, and not the £15 version that guarantees you will lose and must abide by that decision.
If you do try an IAS appeal then ensure you include as much evidence as possible about the lack of signage, your primacy of contract, the predatory tactics of the parking operative, lack of grace periods, using irrelevant signage from a different location etcetera.
Warn the PPC that you will be reporting them to the ICO if the charge is not cancelled for unlawfully obtaining and processing your personal data.
Warn the DVLA that you will be reporting them to the ICO for unlawfully selling your personal data.
Please do follow up on your complaints and report them to the ICO.

My apologies for going off topic OP and to all those helping you, but I can't find how to ignore a poster? It used to be very easy (been a member of MSE since 2007,) but not now!
I know, I should post in site feedback, but the righteous one is really getting on my tits.7 -
I've only been told by HA there is a 5 min grace period for unloading / dropping off passengers. There is no mention of any pedestrians walkways by HA nor parking signs stating that.
I did a stage 1 appeal as I thought it was a straight forward one, insufficient signage plus grace period not adhered to by Link. They got my details from myself when I appealed.
Whereas my dashcam can't prove I was unloading, as I parked boot nearest door and dashcam is front only, it can only prove I positioned car to unload just after 1747, and the tkt was issued at 1749. Need to see if I can find the footage on when I returned.0 -

We are dealing with points of law here, not rules. You are so far out of your depth that drowning happened a long time ago.
An easement is a right (to do something) over subservient (someone else’s) land. The OP has (must have) a right of way which is necessary to actually access his flat. The Courts have decided that that right to pass and repass must include the right to stop and load or unload. Otherwise the right of way would have no practical value. It is NOT parking.
I see that as common sense prevailing.
Asking the OP for the unloading rules is a trolling attempt to destabilize confidence in the hitherto given advice.
Advice to which you are the only dissenter - as my wife would say, bog off.
BBC WatchDog “if you are struggling with an unfair parking charge do get in touch”
Please then tell us here that you have done so.8 -

I believe that it is against MSE rules to name a poster you intend to ignore, so if you decide to exercise the ignore option, keep it to yourself.
The problem with putting a poster on your ignore list is that you cannot challenge or correct any points they may make. You may also miss them making a valid point.
