Technically…though I know this won’t cut it with here, it’s the Creditor who instructs the solicitor and HCEO.
Or the court as the HCEO has to follow statute.
I can’t see the HCEO has acted outside his remit here. There are worse cases than this.- All land is owned. If you are not on yours, you are on someone else's
- When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
- All land is owned. If you are not on yours, you are on someone else's and their rules apply.

Hi to all,
Have finally received SAR replies from dcbltd. On pictures i can see my vehicle driving in and out of those premises with dates/times in and out (including time spent on), but not the actual parking. Is this still considered as parking and breach of T&C??. The spot is a dead end road with a few parking spots. Since the spots are mostly occupied me and others tend to park on yellow line. Since i can't see the actual parking i'm not sure how to interpret this. (in Total there were 3 similar "parkings" as being told by ccbc on the phon)
Many thanks0 -

These are non-POFA Notices so they can't hold you liable as registered keeper. Highview don't use that law, and if more than one person drives your car there is no evidence of the liable party (driver).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

While everybody were celebrating the winter holidays, dcbltd was working (got this yesterday by email). Same time the Court has sent me the "invitation" for 4th of January. I've been given less than normal 2 weeks for preparation. So as i understand:
1) they have lied to the Court again that the claim was served correctly. I don't know where did they sent the previous claim form but the actual address they knew 3 month before the CCJ. I still hold the proof
2) They, i mean dcbltd, did not accepted that had missed the correct address but at the same time accept that the original claim was addressed to someone else? At the same time they blame the Court for accepting the wrong address?
******How legal is all this? Looks way too insolent for a simple private company. From what i know, misspresenting at Court might create huge problems even a company being shut down. Please correct me if i'm wrong
3) they wouldn't be present at hearing on 4th?
4) they have omitted my expenses in the proposed draft order
Please have your say about this!!!!
