  • note the pedestrian crossing leading out of the So called Starbucks only car park - the sign mentioning that it is a Starbucks Carpark has it's back to pedestrians and McDonalds are actaully welcoming visitors from the car park with images of their produce?  This forum won't let me post a link but you can look it up on Google Maps quite easily if anyone is interested:  /maps/place/McDonald's/@51.8755991,0.250017,3a,75y,246.3h,74.15t/data=!3m6!1e1!3m4!1syNVg3Ba_NadRRRwA2fY1lA!2e0!7i13312!8i6656!4m5!3m4!1s0x47d88f3373b4fe63:0xf85f43db6cc1b1c3!8m2!3d51.8753841!4d0.249575

Thanks Coupon- Mad - MET rejected the first standard apeal and have given me a POPLA code. They claim they are confident there is adequate signage and that the car was parked in Southgate Car Park not Macdonalds Car Park. There are signs for Southgate park car park allowing 60 mins free parking for customers - its not clear that a retail park accessed from Southgate Road isnt a single car park. There is no boundary barrier or fence.  There ARE road markings directing  pedestrians out of the parking bays accross a zebra crossing to a pavement that is beside Macdonalds Drive through - nobody would guess they were leaving one car park and entering another and nobody would guess visiting one of two fast food outlets on one trading park would result in a penalty charge of £100 for failing to pay by phone. They incorretly assumed the RK was the driver - I have correted them of this in wiriting still the ask me to pay or apeal to POPLA.  The Original notice to keeper was recieved 9th November,  date of contravention was 9th October and the notice was issued on 3rd November. Monitoring was via CCTV no notice was left on the car. I see lots of posts but nothing confirming what MET have done is wrong or what caused POPLA to cancell the Charge issues at this site and why?

POPLA will enjoy you using the Joe Lycett video link as a piece of evidence.  It will probably make MET withdraw!

Is the PCN a POFA one or not? Easy win if not.

Looks likely to be PoFA non-compliant. @TheBoySmudger - please confirm dates.

here are the docs I  don't know if they are POFA complient or Not?   Thanks both for your help. The Joe Lycett video explains the rediculouse underhandedness here perfectly I think are you seriose about shareing this with POPLA? or was that a Joke - in which case appologies for sense of humour absense.  I replied templated reply to MET = rejected. They replied assuming I was driver - I have confirmed I am the keeper and was not at the car park. Carpark is called  Southgate Car Park and says first 60 mins are free as per the sign - There is no boundary beween car parks one assumes its just one car park as per the video. There is no warning Macdonalds is not in Southgate car park why would anyone think it wasn't  There is a pesdestian crossing from where the car was parked to the pavement outside Macdonalds - again no warning about not being able to visit Macdonalds from Southgate car park.

You enter and leave from Southpark Road:

First Sign you see says Macdonalds customers  Max Stay 60 mins :
    https://ibb.co/zQc799B
There is no visible Boundary within what MET Parking claim are two car parks -  if you follow the pedestrian route from from the cars in this image, cross the sign posted pedestrian crossing and walk along the pavement outside Macdonalds you no longer qualify for 60 mins free parking and get an invoice for £100 - how can that be right?

Most people (even if they saw the sign with the small print) would assume leaving the 'car park' would take place via  the Entrance/Exit  you came in on Southpark Road?

Thanks for your expert advice here.  I run a publicity business and have  Linked-in connections  with The National Operations Director UK & Ireland at Macdonalds  and the Head of Operations at Starbucks UK. Both have links to the Joe Lycett video and I've invited comments - no replies todate!

Totally serious that you should upload the Joe Lycett video to support your case.

great - well  Senior bodies at Macdonalds and Starbucks UK have it and I think it sums up the scam quite well. Would you mind reviewing the docs I've been sent and let me know your thoughts on POPLA apeal. Much appriceiated!

Ok, I didn't look at all the signs....no need because the NTK is non-POFA in terms of wording and the date served.

    The keeper wins.  100%

MET will give up when they see an appeal to POPLA where the first point says you were not the driver and that the NTK is non-POFA.

Go find either a Smart Parking or a Highview POPLA appeal that has the wording about why a late NTK like this, is non-POFA.  Saves us explaining and you wondering how to word it!

I am glad you have done this.  McDonalds appear often on here and are in denial that customers are constantly being scammed,

Be interesting to see the replies
