  • Hello all again!
    Today the D received a N180 form through the post.

    The D is trying to fill it out from the advice set out in the Newbies thread (2nd para) However, the form is a little different to what is laid out?
    Part D of the N180 is now 'Suitability for Determination without a hearing - Yes/No
    Could anyone advise if there is new advice given the change in forms, as D only has until 23rd Jan to lodge the document.

  • Also, how likely is a telephone hearing nowadays? I know it was a big thing through lock down, and have read through threads dealing with the difficulties arising from non face-to-face hearings? just wandered how likely they are now?

    Find a poster called @Grizebeck, click on the name and go to the profile, click on discussions and scroll down to find the New Questions on the N180 Form it is about the new N180 - DQ for and gives the answer. CLUE - you do not want a case to be heard "on the papers".

    Relatively common. It will be BTMeetMe or Teams or Video CVP.
    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    Hi, any more help on this thread would be appreciated.

    D filed the N180 Paperwork outlining dates that could not be made, however has since received a Notice of Allocation from the local court outlining the preliminary hearing has been set within those dates.
    D has since contacted CCBC to inform them, and hopefully get it moved to a suitable date?

    D would like some advice re the next steps:

    In the Allocation of hearing D has to now provide all parties with witness statements/ evidence to support the defence.
    However, as mentioned in the original post. D was not aware of any NTK or subsequent letters until the one received from Northampton. So they question is, how can D provide witness statement or evidence to a case where D was never aware of it?


    It is understood that if bad lighting or signage was to blame etc then evidence from the site can be provided as defence, but unsure how to proceed in a case where D was not aware and can still not locate the site of the offence (other that what was outlined in the initial Northampton letter) is to provide as evidence? 
    Any help or advice appreciated? @Coupon-mad @Le_Kirk

    Your witness statement (WS) should be provided by the deadline set by your notice of allocation (if it included a deadline) and in the meantime, keep on at CCBC because they have failed to acknowledge and act upon your instructions in the DQ.  Your WS should back up and support your defence, which must have been based upon the particulars of claim that were on the N1 claim form.

    Just SAR the DPO of the PPC but they have up to 30 days to respond which may or may not be in time for your WS submission. Has the C sent you a copy of their evidence bundle yet?

    The Defendant must point the date error out urgently (by email) to the LOCAL COURT not the CCBC, who have nothing to do with hearings.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    ok, D has done this. Just awaiting a response.

    On another note, very interesting development. D has today received a call from representatives of Parking Company, offering D a 'deal'  in settling out of court? and offered a reduced fee.
    Is this normal practice or scam tactics?

    Normal practice, especially when they know they have a very weak case. Do not accept any offer except that they drop the entire claim and reimburse you for anything you've had to outlay in defending it so far.

    If it's UKPC/DCB Legal, you can expect a discontinuance any day now.
