    That appeal rejection letter is frankly just what you would expect. Allowing appeals does not make them money ! Forget any notion that you are dealing with reasonable people.

    Personally I would do the PoPLA appeal, even though they are about as useful as a chocolate fireguard. To me, it shows willing if it ever gets to court and puts you in a good light.

    It would seem that you were only just outside a ten minute grace period and then some of that would be exiting the car park, not actually parked. Also, although they try to overlook any effect of the blue badge, you do have someone who needed extra time, and if they are not going to allow a person with protected characteristics extra time then that is discrimination under the 2010 Equality Act. It also sounds as if the signs are pants.

    Plenty to go at, it seems, if Plan A does not work.

    Personally, I find it amazing that a retail park wants to put people off with "90 mins and then go or else". Don't they want people there spending money?

    Border Retail Park has the lowest time for parking,  even the tesco next door has a longer parking allowance,  I will try the POPLA route because ifind it ridiculous what they are trying to do especially in the current climate

    Don't forget that PoPLA is not binding on you if they back the money grabbing PPC. They might do that, as in my view they are neither competent nor independent. Even if that happens, expect a few nasty debt collector letters which can safely be ignored, and be ready to win in court if it ever gets that far.

    It may not. PPCs do not like it when people stand up to them.

    So, I have an update on this one...

    Instead of going down the PoPla route I telephoned the land owners and struck lucky because the person that answered was one the people (Kim Potts) that looks after Border Retail Park, she asked me to email the ,main guy that looks after that site (Tom Winter), he asked me to give him some time to speak with Ocean and revies their regulations for the site... Forward almost a month and had this reply today...



    Apologies that you have not heard back from anyone on this matter.

    I have chased this up with our parking provider now and requested that this be cancelled.

    MAPP recently took on the management of this site from the previous managing agent and have instructed Ocean parking to take over from the previous provider. 

    We had initially rolled over the parking restrictions that were already on site but having managed this for a short time and in light of your recent ticket have now chosen to extend the parking allowance time to 2 hours to come into line with other car parks nearby and to allow customers to the retail park more time on the site without risking abuse by longer term parkers.

    Please let me know if I can assist in any other way.

    Would you mind linking this thread in the 'Successful Complaints about Private Parking Charges .... ' thread which is linked in the NEWBIES FAQ Announcement, as it will be more visible there than in your primary thread which will rapidly slide down the forum thread list greasy pole ... and well out of view to newbies as time moves on. We really want to encourage the landowner complaint because that works far more often than people imagine.
