Letter of claim DCBL/UKPC

I’vebeen reading the forum threads but I think I’ve ran out of things I can do and I need further advice. 

On 26/02/2020 I parked in a car park that was managed by UKPC with my company car infront of curry’s store as I work as a rep and visit stores as part of my job. There was construction work going on so there were limited amount of parking spaces. The person who was parked on the right of my car parked at an angle in my parking spot so I had to match their parking but that got my car partly in the disabled bay parking spot. I was in curry’s for about half an hour which I could prove with the visitors book in store. When I left the store the car that was parked next to mine (I remember still it was a black bmw) was gone and I had a nice yellow sticker on my windscreen. I found the parking warden and I spoke to him but he said he couldn’t do anything and I had to appeal it online. I appealed on 7/3/ 2020 but I didn’t receive a reply. I started getting a lot of letters from different debt collectors companies which I ignored. Last year I left the job and changed address in august with another company car..This year I changed address again in March and beginning of September I got a “letter of claim” from DCBL  at my new address??? 
I complained to UKPC saying that I haven’t received a reply from them to my appeal so my case should still be with them and I don’t get why I’m receiving letters from other companies to which they replied saying they responded to my appeal on 13/03/2020 and I have no received such a respond. They also said that my case is now with DCBL and gave me email and phone number to DCBL limited not legal. I emailed the email address I was given by UKPC and DCBL limited said my case is with their sister company. I emailed UKPC DOP  team for SAR where they sent me the appeal response as well.  

However, now that I received all the data and I actually have a POPLA code do I email them? Do I email DBC legal? I’m not sure on what to do. I received the letter of claim that’s dated 30.09.2022 and I obviously have 28 days  and I’m running out of time. Any advice would be much appreciated.

I also forgot to mention that I complained to DVLA as well. It is weird to me that more than 2 years later and changing an address twice DCBL legal got my new address and sent me a letter. They money they’re asking for is £160 as well.

    Whilst you were reading the NEWBIE sticky/announcement, did you find the second post that tells you what to do when in receipt of a letter of claim?
    Pre-action stage:
    If you have a 'Letter of claim' or Letter Before Claim (LBC), a claim IS likely. I mean a 'real' LBC with a 30 day deadline and reply forms.

    DO NOT use the 'reply forms'. You do not have to declare your finances!

    This is a chance to see the PPC's hand - so send them (NOT their solicitor!) a Subject Access Request 'SAR' listing what you want to see by way of data the PPC holds about you:

    YES! And I did  send an SAR to the PPC and they sent all the information they hold for me now as I’ve already mentioned.  What is the next step?

    Well, you'll need to reply to DCBLegal robustly and narrow the issues/explain the dispute.  You have to do that, to look reasonable in case you ever get as far as a hearing.

    They'll knock you back, then await a claim.

    Then - after dragging you as far as WS stage - they'll discontinue.  You'll know this if you've been following the ongoing DCBLegal discontinuances thread by @Umkomaas

    It is a lot to digest in the thread as of 64 pages, is there an example email if what other people emailed and were successful?  As in what points are good to mention etc?

    It's not meant to be read for hours, it's there purely to skim-read, to make you laugh, to give you that lightbulb moment, the confidence to know what will happen in the end.

    My reply above tells you what to do and that they will knock it back. You just write the email yourself about your case.

    Just relax and play the game.

    You know it won't be resolved just yet; I explained this above. My reply already told you exactly what will happen and when/how you will win in the end.

    Think I got the threads wrong. I’m a bit stressed  and worried of the what ifs.

    got a reply from DVLA to my complaint saying they didn’t pass my data to DCBL legal, it was passed to them by UKPC. But UKPC doesn’t have my new address in a different city, is it worth mentioning how DCBL legal got my new address? 
    And they said UKPC is an ATA member hence they released my data.

    It is a GOOD thing that DCBLegal traced your correct address.  Of course they can and should do that before filing a court claim.

    Indeed they must, under the BPA CoP.

    More of concern is that you obviously need to tell DCBLegal and UKPC (both DPOs) to 'erase' the old address from their databases, so that it can't be 'accidentally' used for the tedious court claim.

    The only 'what if' that you need to worry about is what if they serve a claim to the old address because they still hold a choice of two at the moment, unless you've already done what the NEWBIES thread tells you to do (in the section about doing a SAR) and tell the DPO to erase the old address.

  • Made me wonder how they got my address. I sent a reply saying I'm seeking debt advice and I need further 30 days and that I deny any debt. do I explain the situation same as I did on here and say I've never received a response to my appeal from UKPC? 

    Also what is best practice to find the actual land owner? I was a visiting Currys store as a rep so I signed in their visitors book, but obviously Curry's was in a retail park owned by someone else.

    SOME IDEAS ON DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.

  • I tried google but couldn't find any relevant information. 
    The car park was Brooklands Retail Park, port road, Cardiff, CF5 6XJ 

    one last question, I hadn't received appeal response when I originally appealed. I only got the "response' when I emailed their DPO for SAR and I found the appeal response in the folder, but I was wondering is it worth getting in touch with POPLA as well? as far as I remember I never received NTK either and it wasn't in the file folder I was sent by UKPC either.
