    It's now 6 days since you posted the question, and I'm guessing you still haven't sent the form back.
    As it says at the borttom, the penalty for failing to identify the driver is up to £1000, 6 points on your licence, and if you don't then lose your licence, you'll have to explain to your insurance company how you managed to pick up those 6 points when you come to renew.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Indeed, but he won’t need to explain. The MS90 endorsement tells them enough, and insurers don’t like it.

    Indeed it does. The MS90 endorsement makes them wonder what the driver has done that he does not want the police to know that he did it. So they assume the worst. And the insurers' wonder will last five years. I have a sneaky suspicion we may hear nothing further from the OP.
