Excel has today lost another Lichfield case at Nuneaton. The defendant was assisted by the FB group.
This was the third time she had been to court the first time was rescheduled. The second time Excel did not send the paperwork to the Elms representative.
Elms rep asked for permission to appeal on the grounds of the judgment and costs. The judge allowed the rep to telephone Excel to ask on what grounds they should appeal. Elms came back with Excel's answer and the judge said "no grounds to appeal".

The FB group does not post the individual DS and WS on the page. I think that you will get the pretty much the same advice on this forum. I am posting up the results of the hearings. It's fairly early on in the stages of the hearings and there will be more to come.

Excel lose yet another Lichfield case.
This case involved a BB holder who received a PCN in the early days when Excel had taken over from the council. The judge was not having it that the signage was insufficent to warn of the changes.
The BB holder was slightly over the 10mins and the judge allowed that on the basis that a disabled person needed more time and the claim was dismissed

The judges are finding the best reason that they can to dismiss these cases and that would have been the best reason as it involved the Equality Act. There would be no chance of an appeal.Ed2022 said:

The driver could have easily parked on the opposite side of the road had the signage at the entrance been good enough to indicate that the Gresley Row and Backcester Lane car parks had been taken over by a private operator.

My DS was relatively short as on the PoC it had the wrong date. As alluded to earlier put the ball into Excel's court.2 -
Today Excel has lost another claim at Walsall Court. The defendant was assisted by the FB group. The District Judge has heard and dismissed previous claims from Excel.
Hearing was over in 5 minutes and I don't know at present on what basis that the claim was dismissed.
Such a shame though that many people paid up.
I was in White Stuff in Lichfield on Saturday and the assistant was saying that business was slow and that it was not worth opening for late night Christmas shopping as they did not get any customers in the store. The town was very quiet for the first Saturday in December. Coming past the WM Designer Outlet the car park was packed but it is free parking all day.

Further to my recent post. Case dismissed as Excel had not sent a Witness Statement and defendant had paid which Excel acknowledged. Claim was bought of basis of only part of the VRN input. I gather the judge was getting a bit annoyed with these claims.
We have seen copies of the VRN lists that Excel produce for these two car parks and there are very few full VRN's showing.
