I think you’ve made a number of mistakes here. Your best bet is to stop making any further, take the advice on this thread of cease all contact.

I really hope the part you bought for them wasn’t expensive. They’re probably rubbing their hands together with joy at the moment expecting a free car or maybe even get you to pay for them to have the car.

Yes I had money-saving expert change my name. I emailed them. Because it contained my name they were happy to change.. I wanted something more private. I made the account years ago and clearly didn't think it through lol.

It wasn't expensive really, less than £50.

What mistakes do you think we've made? Paying for the part?

Well we won't be doing that. After speaking to various sources, this sites help included, we'll be ceasing contact until/if we get a SCC...

    Most have already been outlined:
    • Paying for the part
    • Continuing contact when you knew you had no obligation
    • Delivering the car so far
    • Not really confirming the address of the buyer
Ultimately most of these might end up not being that serious and if you only paid £50 for the part you might not be that out of pocket. However when you next sell a car at least you'll be a bit more aware of the potential problems.
  • They have refunded the money for the part we paid... So I don't think it's a scam but not sure what they're doing? She gave us 7 days to reply to last letter, which we haven't as advised..i think that was 5 days ago today.
  • Could I ask what you would be advising me, if the shoe was on the other foot.

    If I came and said:

I just bought a vehicle off of a private seller 3 weeks ago which broke down after a couple weeks, and it's been said to be the timing chain has broken.

Would you be advising just as youre advising me? Or would you be telling them to take it further?

I'm just trying to put myself in their shoes and I imagine everyone on their side of the argument is going to say we're in the wrong ripping them off. Which obviously I disagree with; we can't tell the future.

We've already explained the legal position - there isn't a different set of laws if it was the buyer asking us for advice!

Sometimes things just suddenly go ping.

I would ask exactly what the advert said and ask you to post the exact wording, whether you spotted anything unusual when you inspected it, and whether the car felt like it ran well when you test drove it.

I would also ask who exactly had diagnosed the problem and what exactly did the engineers report say.

If you then told me you declined to test drive it, and the advert had described it accurately then I'd advise you that unfortunately these things sometimes happen, and unless you can prove that the seller as deliberately tried to cover up a problem then you would need to suck it up.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Thank you so much. I appreciate all of your help and will let you know if anything more comes of the situation.
  • Letter before action received.

Claiming it doesn't match product description (which it 100% does) and is defective. It was delivered with 12 months mot and fully working, having never broken down for us!

It might be defective now but it wasn't that way upon sale!
