I've had a similar response from Jet2 (rejected due to staff illness and exceptional circumstance citing BA Flyer case) however we know that it wasn't down to staff illness that both the outbound and inbound flights were delayed.  Any advice on what more I can do?
What evidence do you have that the delays weren't caused by staff illness(es), that's compelling enough to counter Jet2's assertion that they were?

If you can be sure that staff illness wasn't the reason for delay then go back to Jet2 stating this, make your communication a Letter/Notice Befoe Action.give them 14 days to reply with a payout offer.
If they don't , start small claims action via MCOL. Jet2 aren't subscribed to any ADR service.

  • I have just reciced an update after sending a polite email to the CEO requesting a revisit on my claim.

jet2 are still not budging on the claim moving forward, still stating they are waiting for the outcome of the Lipton vs Cityflyer case which, on the 8th July 2022, was granted an appeal in the Supreme Court

A date has still not been set for this. The original judgement for this case was March 2021

I explained that this case was still law until the new appeal was heard, but no movement wrt my claim until this judgment given

I would have put an MCOL claim in. That would force the issue re staff illness as they would have to prove this in court.
And you can start the clock ticking on 8% interest ....
