No, it won't get thrown out unless you follow what is shown in the CCJ set aside threads from this year, such as by:

There's a road ahead of you that loads of people have successfully travelled here before, and you must act promptly. Next week for the N244 application.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guysJust an update. I got the SAR back through email and it contains stuff like the car park photos at the time, copies of UKPC notices, copy of my (very minimalist) appeal shortly after receiving the notices. I have tried to contact all three parties involved (UKPC, DCBL and the involved court) to discuss the case but have been passed about to each other claiming no real detailed knowledge of it.I have also received another dcbl notice stating they may proceed to the next course of action which im assuming would be court. What is the next course of action to appeal the case now I have my SAR back? @Not_A_Hope @co@Coupon-madThanks and happy holidays0

You've been very quiet for over three months.
Has the set aside been achieved?2 -

Your thread title says you have a CCJ therefore you have to PROMPTLY apply to set it aside.
Have you not done that yet? Or is this not a CCJ case?
I am really confused because you now say:
"I have also received another dcbl notice stating they may proceed to the next course of action which im assuming would be court..."
If you have a CCJ it's already been through court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Look at the threads advised by Coupon-mad in Sept.

Hopefully by studying what steps they had to undertake you will begin to understand the process you need to follow to sort this out. First promptly apply to get CCJ overturned. Then prepare to defend the claim2 -

If you have a CCJ it's already been through court.Fair enough, I assumed I would need to review the SAR documents before writing any kind of defense and putting forward a set aside claim.Just to clarify the last letter was a seperate ccj notice reminder, the car was parked in the same lot twice in the space of a few days so there are 2 pcn charges. The CCJ's have been through court but have not appeared on any credit reports yet. I will start the n244 application now, two of them actuallyThanks again to all the responses0 -
So they made two separate claims? That is a clear abuse of the court process and Henderson v Henderson* needs adding to your WS argument, each one cross-referencing the other claim number.
* search the forum.
Get your N244 and WS and evidence emailed to the CCBC fees email address mentioned in those other threads, ideally by Monday morning (and ring up to pay the 2 fees) or you are going to look so late applying that you will get refused.
