UKPC PCN Fine/CCJ - please advise

Hello guys, i'm new here and could use some help with a parking fine thats escalated into a CCJ.

I'll try explain as best I can, it's a bit of a tricky situation I think.

I was given an old car by a family friend of my uncle when she bought her new one, I registered the car etc. For financial reasons I had to sell it not long after.
Eventually my uncle found a buyer and since I was going to be busy in work he arranged and finalised the sale. Unbeknownst to me for a long time after, neither my uncle or the buyer registered the new ownership of the car.

Where the fine comes in. The new owner parks in a PCN car park, not far from my area twice in a week. Obviously the UKPC send me the fines as im still registered as the owner. I'm bewildered and ask my uncle what the deal is and he says they are basically parasites and to simply ignore the. I do for the first 2-3 letters then I decide to send an appeal explaining the car is not mine. This didnt go anywhere. In the meantime I had also contacted the DVLA to update the records correctly and the vehicle is now registered as not mine before the date of the charges.

Now, a long while later they have DCBL chasing me up for an amout of just over £500 including the accrued interest and court/solicitor fees and just found out they have a CCJ on me. They had been sending the dcbl letters to an old address and only just been made aware of them. I contacted DCBL, they weren't much help, they have to keep pursuing the debt for their client. They refered me on to a court in Northampton that issued the CCJ, they told me I can either pay the money to remove the debt and CCJ or basically go to court.

I wanted to ask what is the best course of action next. I havent contacted UKPC yet, I remember it being impossible to contact around the time of the original fines. Would writing a letter to them help anything at this point or is it too far gone? If any documents i have would help i will post

    Hello and welcome.

    Do you really have a CCJ - a County Court Judgment - or do you perhaps have a County Court Claim from the County Court Business Centre in Northampton?
  • Even if you pay now your CCJ will be marked as satisfied but will still be there on your record. Best thing to do is search the forum for recent CCJ cases and specifically ones where the claim has been sent to an old address. The parking companies are supposed to check they have the correct address for service (costs them 29p). 

     It costs about £275 to apply to get the court to remove the CCJ and this should be requested to be refunded by the PPC as it was their error that led to the CCJ. Then you need to defend the original claim and provide evidence you were not the keeper of the vehicle at the time nor the driver.
  • Have a look at the thread form RMS22 ‘CCJ for parking fine’ which is a recent example of a CCJ set aside because of the PPC using an old address.

    By the way it was never a ‘fine’. It was a speculative invoice arising from an alleged breach of contract that you failed to pay.

    This is the letter I recieved. Yes it was actioned by the business centre. My credit score shows no CCJ, but they can take a while to show up I've been told.

    Yep I'd rather not have that ha. It might have been my address at the time you see, I was in between houses and it was a while ago and hard to recall. Would this be the strongest argument in my favour though? I would think the car not being mine at the time would be more than sufficient, if I could prove it somewhat of course.

    I'm writing one up now, I've included what the thread has noted. Do I need to send any proof of identity or y DCBL ref number?

    As you no longer have the car or it’s V5C log book send them a copy of the CCJ letter they sent to you and perhaps a redacted utility / bank statement with your address on. No photo ID such as passport or driving licence. They need proof of who exactly they are sending personal data to under GDPR.

    Would this be going in the direction of getting the case throw out due to wrong address as you mentioned earlier?

    I have sent them a SAR, it may take a while for them to get back to me
