Hi!So am I right that I complain to the PALS route (which I will need to research) before 4pm 20th Sept or do I need to additionally submit a defence to Parkingeye?
I know this is likely in the threads - I am reading - but it is hard to interpret and understand what’s relevant to myself.0 -
Also, the CCJ letters are in fact the only ones I have. The previous ones must have been sent to an old address as my V5C was registered to an old address.Will this make a difference?0

It is nearly a month since it was suggested you complain to PALS. We can’t help with the email address because you have not said which hospital was involved. However you should do this ASAP to kill off the claim before it goes to a hearing.
You are leaving until the last moment but you must submit a defence in parallel with your PALS complaint. KeithP told you the deadline but because of the extra bank holiday on Monday you now have until Tuesday 20th to complete it. Otherwise you will lose by default and pay the maximum the parking company have submitted to the court.You don’t have any CCJ letters. It is a County Court claim not yet a judgement.
You still haven’t explained why the driver didn’t realise or why ‘suffering badly with a condition’ would be a valid defence. You must be able to explain it to a judge.
Whatever you do submit a defence based on the recommended Template and hope in the meantime the complaint to PALS / the CEO of the NHS hospital is successful.2 -
Yes you are correct- I was hoping I can put together the defence by the deadline.Hopefully I will find out the correct email address for PALS.Thank you for the correct yes a County Court Claim not CCJ.Is it definite I will go to court for a hearing then?Thanks again and apologies as I have done this years ago and can’t remember it being so confusing.0

If you submit a defence in time it will then be up to the claimant to tell the court whether they wish to proceed or not. They almost certainly will want to. You will then have to submit a witness statement to your local court and the claimant will then have to pay a hearing fee.
The court hearing may be in person at your local court, by telephone or other means. Depends on the court.However PALS or the hospital could get all this cancelled instead.1 -
Don't forget NOT to use the Template Defence which clearly says it is not for ParkingEye cases.
Instead, go adapt one of the ParkingEye defences in the NEWBIES thread, but of course with the 2020 statement of truth.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Im looking at the past Parkingeye defenses on the NEWBIES thread and noted the need to use a statement of truth.However the only paperwork I actually have is the County Court Claim - all other paperwork must have gone to my old address.Is this something I can use in my claim - the fact I haven’t actually had a chance to pay/defend the original parking fines?
I am also confused with the court hearing - I never had to attend one when I defended a County Court Claim in around 2017?0 -

They aren't fines.
Email a SAR to PEye to get all the letters & photos.
