DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS

Hi everyone in this forum,

I've been reading the threads including newbie's to assist my defence against Euro Fraudster Car Parks Ltd.

What happened was that on the day of parking my vehicle in one of their car parks in England in 2022, both machines were out of order. So I called the number on the signage to pay over the phone using my card. After entering my card details to the automated call, the voice said, 'Press 1 to start a session'. So I did. But it didn't ask me how long I wanted to park my car. So I emailed ECP on the same day to ask how much they were going to charge my card. They did not respond at all. I called the phone number on their website to enquire about it as well, but to no avail, as no one ever answers calls on their official phone number.

One week later, they replied to my original email saying that I have been issued a PCN. There was no date of the issue in the email. Instead of responding to my email enquiry, they had the nerve to inform me of a PCN in the return email a week later. They also applied to the DVLA, who is complicit in ECP's fraudulent activities, to obtain my home address, despite the fact that I included in my initial email my full name and phone number.

Anyway, fast forward, I kept receiving threatening letters from people acting on behalf of ECP. I didn't lose my nerve and kept ignoring those letters as I believed I hadn't done anything wrong. Ultimately, it was ECP who did not charge my card despite having my card details. In the end, DCB Legal took over my case. Then came a Letter of Claim in January 2025. I followed your advices in this forum and put my own defence in the defence form.

I received a letter from the local court in April saying that they couldn't find my defence form. It appears it had been lost while in CNBC. So I had to re-send my defence to the court.

On 25/6/25, a paralegal for DCB Legal emailed me saying that the Claimant 'may be prepared to settle this case. I can confirm our Client would be agreeable to £20.00 in full and final settlement of this Claim. The current outstanding balance is £295.80'. I declined this and replied to him saying that I'm doing this for Justice, I will expose before the Judge ECP's fraudulent activities in court. The court date was set on 29/7/25.

Then came the Claimant's N279 Notice of Discontinuance on 27/6/25.

So after 3 years of nuisance and harassment, I won the case without going to court. I knew the outcome would be this, but ECP still tried to scare me to pay up the so called 'fine'. I guess may unsuspecting motorists just pay up when they receive threatening letters. Ironically, after watching 'Can't Pay? We will take it away!' programme, I knew that CCJ will not be issued unless you lose your case in court, and bailiff will not take your goods away unless you fail to pay after losing in court.

Anyway, I wanted to add my case in your ECP/DCB Legal Hall of Shame.

Thank you everyone in this forum who have spent their time and have left useful advices to tackle these fraudulent activities by private parking companies. I'm greatly indebted to you all.

@BMWF30. Can we please see the actual N279 they have sent you, it's what we're using as base evidence for the Govt to see, then I'll get your case counted. Well done on getting this out of your hair. 👍

Discontinuance #

I have about a dozen other Discontinuations from over on FTLA but I really can't be bothered anymore. It is a simple fact that any claim for a single or even several PCNs issued by DCB Legal will be discontinued as long as any defence is submitted. It really doesn't matter what is in the defence.

It is clear that these discontinuances are a drop in the ocean for this bulk litigator and for all the effort they put in to issuing the claim, they only need a few of the many who either fail to respond or pay up out of ignorance and fear to cover those costs.

I am tempted to try the following as a defence in one of them, just to prove a point:

There once was a charge quite absurd,
By DCB’s pen it was stirred.
But write I must do,
So this verse here will do —
Now drop it, lest courts think you’ve erred.

Any takers on whether putting that into the MCOL for the defence will still end up as a discontinuance?

I'll see how I get on with my first case against FP/DCB Legal...if it goes well and another claim is received for the other PCN, I'll seriously consider this ditty for section 3 of the defence !!
