What is your deadline for submission of docs and have you submitted? Courts tend to give claimants more leeway than defendants so don't be surprised if the hearing goes ahead and late docs are allowed. If it does go to a hearing the first point you raise with the judge is that the claimant missed the court mandated deadline.2

Dont worry, I know it's a long thread and I think I confused you with what I was asking. I've just received a letter from the courts today which answered my question anyway
IT IS ORDERED THAT
1. Unless the Claimant files and serves the written statements (including any documents) ordered by the Court in the order dated 27 March 2023 by 4pm on 2 June 2023 the Claim is automatically struck out on that date at that time and the hearing is vacated and the Claimant is automatically debarred from relying upon any statements and documents not previously filed.
So they have until the end of this week. A little bit annoying giving it appears to be an extension from the previous 3rd April 2023 date ordered.3 -

It'll be interesting to see if they do serve anything by Friday. I assume they will email the court, but send me a paper copy in the post rather then emailing me?
I'm not sure if I should take this as a positive or negative really. On one hand it's giving them an extension of time, on the other hand if they fail to meet this second chance, it's yet more evidence of them ignoring Judges orders for me to go back after them with.

So post man has been, nothing in the post from BWL. No emails received either. 4pm deadline today (second deadline).
Just phoned Southampton courts and nothing is showing from the Claimant yet on their system, but he did say there's a bit of a back log and I should call back mid next week, or wait to receive a letter confirming its been struck out. Slightly frustrating as I thought by close of play today I'd have an outcome1 -
I'm afraid no one is sitting around with a stopwatch checking deadlines. Frustrating, but a symptom of the cut backs in funding and the flagrant abuse of the court system by litigation-rampant PPCs.Please note, we are not a legal advice forum.
