There are several options but you have to ask the court to enforce your judgment. They won't do it otherwise and you may have to pay a fee that will (should) be added to the amount owed to you.
You can try and get your money (called ‘enforcing your judgment’) by asking the court for:
- a warrant of control
- an attachment of earnings order
- a third-party debt order
- a charging order

Morning All - todays the deadline to receive the new claim form/money. I had got my dates mixed up and thought it was Friday gone buts its today. I've set our German Shepard on the top of the road so the posty cant come near
Regarding the money owed, cant I simply just email the claimant tomorrow reminding them it was due and the date set by the judge has passed?1 -
Personally I think you should send a reminder. If you do need to take legal action it will make you look more reasonable.
If it were me I would give them seven days after which they will be liable for debt recovery costs of £70plus additional court costs if they still refuse to pay, for a Warrant of Control plus interest at the court rate of 8% from the payment due date.

@Fruitcake I'll drop them a reminder tomorrow just to mention they've missed the payment date. Just incase they suddenly realise that they haven't issued the claim and respond with that

Yes, do leave it until after the due date has passed. Do give them a new date in writing, no more than seven days, and do warn them that you will commence legal action without warning if they don't pay by that date. It will make it easier for you if they play billy suggers.

Well, 4pm has passed, so the Claim is also dead.
I just want to thank everyone publicly that’s helped with this, truly! I wish I could pay you back, the only way I can think to do so is hang around the forum and help others emotionally who are going through the same.Who’d thought a quick stop in an car park, so the missis could run into a co-op to pick up a parcel in May 2018, could lead to a year living with a CCJ in 2023. I’m a very strong person (you won’t believe it reading this thread!), I can laugh my way through most things, I run 2 businesses and one is a very stressful full on industry; but nothing compared to this. I didn’t even know what a CCJ was! Let alone acronyms for everything to defend it; which I now get to annoy the wife by using them.
For those that help others, but haven’t had a CCJ, do not underestimate the stress it causes. I was worried if my business slowed, I’d have no access to funds to prop it up. I was worried my car would be taken from me, and so much more. I spent hours researching, and worrying, then finishing work to face my family with a brave face.
I got rejected for a phone contract for £6, I struggled to insure the home because it asked if I had a CCJ and I had to be honest in the event of a claim! Then I had my error with the business bank which meant I couldn’t open another. Theres just so many ways it effects you.
My constant, obsessive nature also played a role in this, I worried I’d do something wrong and create a loop hole for them to get out. Like when I had to resubmit my N244 because the attachment was too large, I spent ages contemplating should I now change the signed date of the document or not. If I didn't change it to the date I was sending it, it would be wrong, or if I did change the date it wouldnt match with the payment date and that be wrong.
But by the looks of it, it’s all over. People close to me keep asking how does it feel to be gone? Its odd, feels like being accused of a crime you never done. I’m glad its over, but !!!!!! it should have never been there in the first place.
BWL trying to send over a consent form the week before court, and 10 months after the default judgement done nothing but fuel the fire, but I never got my day in court. I did however get a signed Consent Order from BWL stating “Upon both parties agreeing that the Claim form was improperly served” so from here .... I’m going to open a bottle of Veurve firstly, and then speak to a few people and see if I take this fight back to BWL/PP now for damages. Its not about money, but if money hurts them it will be.
on cost; my court costs never awarded because I didn't go to court, state 16hrs research ... this isn't even remotely close and felt an insult just reading it. This consumed my life! 160hrs maybe closer to the mark.
So all that is left to do, is to remind them they haven’t followed the judges consent ordered and repaid the £275 by 4pm on 6th March, which needs to be done within 7 days …
Special mention to @Coupon-mad, you've been an absolute rock to me, I'm forever indebted to you, and I'll always be willing and ready to help this fight in anyway I can in the future.
@Johnersh I have an apology to make to you! Way back in the thread you came up with a bit of defence for me, we even said how good you are with words, and made reference to Stella and being reassuringly expensive, however I managed to completely leave it out of my defence
I made a note to apologise to you for this in my prep work haha!
