    Morning All, do you think it's worth calling Southampton court? I received the letter to say its being relocated to the local court on the 6th October but I've still not been giving a hearing date. 

    Just worried as 2 weeks since then and royal mail are constantly striking at the moment and I dont want to miss the hearing date

    No you need paitence.
    It could be months ( for some courts) before its even allocated a hearing date

    @Grizebeck thank you for your quick reply. 

    I'm happy to be patient, it gives me more time to read other cases. I was just expecting a date to be set by now but if it could be months thats fine. It was the unknown

    And then it may be so some months before you get a hearing again depending on court load, but it all depends on judicial availability,  some courts are fairly quick, others are June next year now

    Awfully close that to the end of my lease purchase June  :( fingers crossed its before then so I dont have to sell what I've worked so hard for

    Not sure what you mean? This doesn't affect your credit rating AT ALL, when the court process is played out properly by a Defendant who engages.

    You will not lose at Southampton court.

    Your hearing will be in early 2023. Is this the first hearing, to set aside the CCJ? Sometimes Southampton Judges allow that bit without a hearing.

    You might even get the CCJ wiped this year.

    Just received a date, 17th Feb  :) gives me 4 months to study the case laws, and the law relating to my case obsessively. 

    @Coupon-mad I assume this means there will be a hearing?

    Looks like it - this is your application hearing re your set aside? Seems very late.  Applications are meant to be a priority.

    @Coupon-mad correct, its my only hearing I'm expecting 

    Gives me 4 months; +1 if removed, of living under the same restrictions of someone thats been made bankrupt.

    If successfully removed, is there anyway to sue these scumbags? I'm pretty sure that would stop them obtaining default CCJ's through p*** poor practices

    You can try a counterclaim at defence stage - later - because this won't be your only hearing (unless the PCN claim is entirely dismissed).

    However, counterclaims rarely succeed.

    I'd ring the court and ask if this hearing is the soonest available; given it is a CCJ set aside application, ask if this was suitably prioritised?  February sounds a bit long to wait to overturn a scam CCJ.
