Please don't be sucked in with this. Judges now do not fall FOR the fake £70 as they know it's a money scam. NO DOUBT THEY CLAIM £70 FOR DAMAGES ??? .. not sure who the damages are owed to ... must be the landowner, not OPS. or is it just a word they use to fake their fees ????Wanda_Woman said:Ive had a letter from DCBL suggesting that to save precious Court time and money, their client one parking solution are willing to accept out of court settlement of £200 in full and final settlement, saving me £70 quidsI am minded to suggest they make a £200 donation to a charity of my choice, they pay me £70 for my time and trouble and we call it quits
Same with interest @8% ..... they do not allow
If this went to a hearing. it's £100 for the ticket and £85 for coirt fee and soliciotors cost
That's £185 NOT £200.
Do not be tempted to contact DCBL, let them wallow in their sick attempts
They already know they will get spanked in court where you can claim your costs
So, the question is, will they go to court and face a spanking or discontinue because they have taken on another rubbish claimDCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS

Haha, thats so funny.I decided that win or lose i wasnt going to back down. I can well afford the £270 if sheet hits the fan, and that I would ride this to the end of the line and see how it goesSo i did get a phone call 12 days ago, asking to speak to meI asked who was calling and she said i cant tell you if its not you im speaking toSo i told her to f*ck off and grow up, then call back when shes prepared to talk like an adultShe asked if it was me, i said yes, you know it is, how many other random people do you phone and ask if its them? WHAT do you WANT?She announced she was DCBL and then said I have a file with them?I said her wording made no sense as I dont give a fk who DCBL are and i have better things to do than 'have a file with them' - what ever that meant, and if she didnt stop talking sheet and get to the point, she could fk offShe then proceeded to warn me about my language and i ended the call3

If someone makes an unwanted phone call to me on my private phone number they will take what ever language I give them or not phone their choice, don't let the idiots grind you down they have an arrogance that knows no bounds and they deserve all they get.

I have now received C Court papers, instructing me -1) to try and come to an agreement with the other party, but if that fails -2) Put my side of the story in writing and sign date etc to the CourtHow does one try and mediate with vermin? How does one approach the task?I was thinking to offer them the couple of quid which the hours parking was worth and call it quits - there, take ya feckin money and !!!!!! orf, ya blood suckin.........Or just skip that part and put my case to the Court?Jeez this is all so tiresome over a couple of quid which they have already blown the admin budget on by taking it this far0

Are you saying that you have received a County Court Claim?
If so, what is the Issue Date on the Claim Form?0 -
This is the game you play. Make them a nominal offer on the basis "to assist the court", they will refuse.Wanda_Woman said:I have now received C Court papers, instructing me -1) to try and come to an agreement with the other party, but if that fails -2) Put my side of the story in writing and sign date etc to the CourtHow does one try and mediate with vermin? Then continue with the claim with the help here1 -

If so, what is the Issue Date on the Claim Form? The Papers i have received are - Notice of Allocation to the Small Claims Track (hearing)....The Judge encourages you to talk to the other party...to see if you can agree on a resolution. If so, you can send in a doc.headed 'Consent order' and dates setting out your agreementIssue date of this notification 19th October, but i only received it on 27th - 2 days agoIt says i have 21 days to respond either way

This is standard stuff, all explained in the NEWBIES thread already, in bargepole's Court Procedures thread, linked under IMPORTANT: KNOW WHAT HAPPENS WHEN.
No-one tries Mediation!
Sounds like you need to read that section again, plus the info about WS and evidence tips and the fact that 'defence is not your only job'.
The only out of date bit in it, is the WS example linked (the one by RobertCox). Please don't use that one; it is now superseded in 2022 by ones such as the bundle seen in the thread by @aphex007
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have just received a bundle from DCBL which contains -Documentary evidence of proof of land ownershipProof of right to claim parking chargesAll car park signagePhotos of vehicle entering and leaving with times etcbi lingual complianceAlso - I have not had ANY correspondence with DCBL or their client, yet they claim in their witness statement thatI have wasted the courts time by filing a template defence which fails to address issuesThat I have stated there is no contract between me and one parking solutionIm sure you guys see this all the timeMy one and only point on which im resting my defence is that there is no phone signal in the village and its well publicised in the press, yet its not mentioned once in this bundleI still havent made my court representation, which i must do by the 11th nov because I cant get my head round any of this, the stress makes me sickI just dont know what to do0
-
Amazing they have the gall to say you are wasting the courts time with a template defence. Any judge with an ounce of sense knows that the parking scam goes well beyond the comprehension of most people and that it was wise to search the internet for help. Most judges ignore such poor tactics
They hate this forum because we win.
This is yet another kettle and the pot .... timewasting indeed with over 60 and counting discontinuations by this firm ? That's what the courts call timewasting ?
Regarding the "no phone signal", can you show to a judge that this has been well known, such as newspaper clips etc.
Media interest must have been seen by the PPC yet they continue to pretend you can pay when it is impossible. You must make the judge fully aware of this with proof.
And point out that you advised DCBL of this and they have ignored you
A contract may well be in place but if people cannot pay due to no phone signal it somewhat puts any contract in the rubbish bin, especially the so called contract the PPC says they have with you.
Continue to submit your statement but do highlight the "no phone signal" hopefully with proof and also that DCBL ignored you ,,, which judges are less impressed with.
Also there are your costs to claim
