Although not to do with Parking Companies I notice that another high street presence is on the brink. I don't think that parking is the only issue but it is part of the problem. I can see more stores closing.

I'm guessing that this was a "trial run" in 2020/2021:-

No but (as we all know) that was a different Government in power and that (and the resulting Code) was superseded by the success of the JR challenges in 2022 which the Government could not realistically oppose.
Why couldn't they meaningfully oppose the JRs? Because (one only has to look) it was a fact that:
- they had failed to openly and fully consult on banning DRA fees and
- had failed to do an IA.
This is all known and in the public domain.
After which, the then Government made it clear that they would re-consult (starting from scratch) on debt recovery fees and the PCN/discount caps. And they would produce an IA. But they only got as far as a draft IA (which isn't enough).
They were literally ready to go with the actual IA and final Public Consultation when the GE interrupted that.
All of the above is already openly known.
So that needs to happen now. No choice.

It has to work for all those concerned (motorists, landowners and operators).The last attempt failed as it was heavily sided in favour of motorists. We are told there is a desire for fairness, but siding with one group by no means achieves this.
If there is no balance and justice for ALL, a JR is surely inevitable; so hopefully the Gov are now listening to EVERYONE and not just the loud minority.0 -
More importantly the Govt looks at the evidence than listens.3

I understand a consultation has to be done on the fees - pcn cost and debt fees (though some Lords don't and agree with Jenni_D and Patient_dream).Previous Govt didn’t consult on the fees then they delayed the consultation after the Call for evidence as DLUHC Minister wasn't prepared to make a decision on what the fees were to be. It's now Labour's decision to say what the fees will be and get it out for public consultation.I do believe Labour are using the "legal challenges from the industry" as a delaying tactic. The new MHCLG could go on forever anticipating what legal challenges may come from the industry. And as MHCLG mull over the possible challenges more new evidence of PPCs unfair self centered practices will just keep on emerging.2
