Go read the incoming new DLUHC Code of Practice and find the bit somewhere that states that picking up or setting down passengers is exempt activity. USE THAT AS AN EXHIBIT and refer to it in a new paragraph just after you talk about stopping to pick up a child passenger. I recall that exemption is there somewhere because I was on the Steering Group that put the new Code together. With reference to EXHIBIT XX (DLUHC Code of Practice, term 2.24 parking period), picking up or setting down passengers is exempt activity. This exemption, in my argument is paramount with regards to children.0 -
is exempt activity which is not to be counted as part of any contractual 'period of parking' that can lead to a parking charge.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Once I'm ready to send my Witness Statement to the County Court, do I copy in the Claimant's solicitors' email address too?0
-
Yes, sounds like you need to re-read bargepole's 'guide to court process' which is linked in the NEWBIES thread under IMPORTANT: KNOW WHAT HAPPENS WHEN. Bargepole explains all stages and who to copy in.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry to ask, my bad! 😬0

Ah no it's fine and I answered 'yes', but you might learn something else useful - and gain confidence - from reading bargepole's court guidePRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

One last question (I promise! 😄), I'm sure it's not mentioned in Bargepole's NEWBIES thread - on point No 1 of my Witness Statement, do I begin in with my name AND address?
The examples shown say:
I am XXXXXX of XXXXXXX, and I am the Defendant....
It's the second group of XXX that I am not sure about.
Hope my question makes sense.0 -

Just an update, I received the claimant's Witness Statement this morning (one day after the deadline) in the post. Is there any benefit posting a redacted version on here?0
