Make sure you set the CCBC email address as approved/authorised/whatever the right term is ... you don't want any future emails going astray. (Not that there'll be too much more from the CCBC - DQ notice etc. will come via post).

The Claimant is late filing their DQ, but this reminder gives them another chance. They will. Means nothing to you but you had to be copied in.

  • LATEST:

I recently received a Notice of Allocation to the Small Claims Track (Hearing), the case be listed for hearing before the District Judge in the Small Claims List on 30th January 2023. By 4pm on 9th December 2022 I must file at Court and serve on your opponent a written witness statement.

In my case, I am the keeper and wasn't the driver on the occasion.

How am I best to approach the matter (WS) with regards to not being the driver and what am I best referring to (previous cases) in the Witness Statement?

Look at the NEWBIES thread section about WS and evidence bundles.

But DO NOT adapt or look at the old example there (RobertCox) as that is superseded in 2022 by better WS such as the bundle posted by @aphex007

Your witness statement back up and supports your defence as already filed.  You cannot file new defence points but give evidence that backs up (proves) that what you stated in the defence is true.  The WS pointed at by @Coupon-mad is for style and format and you cannot use what they wrote where it differs from your defence.
  • I am working on the WS statement, but am genuinely struggling to find evidence with regards to the signage relating to the car park when the event took place. UKPC no longer "manage" the car park, who only managed it for a short amount of time, obviously the apparent signs are no longer in situ, plus I've had a look on Google Maps - the latest update being June 2017 (which is before UKPC's control). Is this lack of evidence likely to have a detrimental impact on my case?

Which car park, maybe we can find pics in archive threads?

  • Macclesfield Superbowl.
There's a lot negativity re. the countless parking fines in news articles and TripAdvisor reviews, plus the subsequent withdrawal of UKPC on the Superbowl's Facebook page - not sure if pasting those links in my WS is acceptable?
