There's been no response from the OP to suggest he followed my advice of 31 May. I'd be absolutely amazed if Ms refuse. Never seen one yet, even with non-customer fly park
How did you get on with your approach to Morrisons?

"Spoke to an assistant and said they will look into it, so as time went by I thought it was dealt with!
But this morning received the above Email"
I am back. Here is my reply "someone" did go back to Morrisons but not me to ask to have the fine scrapped.

I forgot that we'd been to Morrisons carpark site shared with several other shops on a Sunday and was worried sick re 60 min no return. I gave Morrisons local store a call on Monday gave them my reg and told them this was a mistake and I'd never done it before - the bloke said leave it with me and don't worry and heard nothing more that was over a year ago. Well done Morriosns.
Morrisons are definitely the best supermarket for cancelling private parking tickets.
    Thank you.
I've never had any kind of ticket for driving every and driven for close to 40 years.
I was worried sick when I reentered the carpark because we'd been to other shops
on estate, forgot something and thought we'd pop back - as we entered I remembered gosh its not been an hour it was about 50 mins.
So call to the local store and I guess they saw we were not p takers, end of worries.

    Never again

When I see CEO's giving parking tickets, I should not be I do have a chuckle.  Some people learn from one genuine mistake and some will never learn.

Again, what did Ms say - doesn't show anything above about that?

Why didn't you go back with receipts and any loyalty card?  If it's your PCN, you must see Ms for them to give this any credibility.

Do not attempt to id the driver at this stage, but an answer to these questions will be of use:
    "would never name driver"

Was this a genuine overstay ie a singe block of parking, or has it taken two visits as one ( aka double dip)   "single block overstay"
was this "overstay" within normal store hours?   "yes saturday day time"
Was there an odd restriction such as a shorter stay period on an undefined match day, or the week following  a full moon ?  "not sure on that one"
How long was the overstay ( roughly)?   "54 mins" someone stayed in their cafe eating cake & coffee!
Was an occupant of the vehicle shopping at Morrisons at the time?   "Yes and used there Cafe"
    Hope this ok.
    Thank you

    Hi all,
Yes I agree, I will have to go back with the letter. I do not have a Loyalty card or a receipt to be honest we hardly ever go to Morrisons. "A Other" shopped there and had a chin wag in their café and obviously went over the time limit not thinking. We live in Ware and its £3:80p to park for a whole day We have no problem paying fees just a DOH! moment at Morrisons!!!
Regards and thank you for your help

Not naming the driver is irrelevant if ECP have met he requirements of the Protection of Freedoms Act 2012 (Schedule 4), which most PPCs do.  They can hold the registered keeper liable.

Does the Ms complaint form ask you to name the driver?  If it doesn't there's no need for you to  even comment on it.

No I did not name the driver and also they do not ask.
    cheers Umkomass.

I received an email from 2Euro Car Parks" declining my appeal!  How do I reply to them to say " I will not name the driver" they say I have 28 days to reply but how there is no link?
this is on the email they sent me?????

""PLEASE DO NOT REPLY TO THIS EMAIL - it has been produced from an address that cannot accept incoming email""

Don't they mention POPLA (and a POPLA verification code) in that letter, because that's where the next stage of your appeal should take you.

You seem consumed with 'not naming the driver', but that is a futile argument if the ECP Notice to Keeper is compliant with the Protection of Freedoms Act 2012 (Schedule 4). Check it out and let us know. How to check for PoFA compliance is in the NEWBIES FAQ Announcement, first post.
