    Hi Jenni, yes sorry for the confusion the CCJ is unrelated to this PCN. My court date is 7th October for this fine. 
  • I have received TWO letters at once today both from BW legal, one letter critiqued my whole defence and then at the end making me aware I can withdraw my defence and pay them in a payment plan.

    The second letter was a letter to say they are prepared to offer me 25% off the amount owed as a goodwill and say they believe they will win in court so dont miss out on this discounted offer.....

    I mean...they are already considered a joke outfit by all accounts but this confirms it!

  • Ok so the court and BW Legal have received my WS. However, I have still not received the claimants one. An the deadline was today? Court Date is the 07/10/2022 is there any defence I can use in relation to them not sending a witness statement?

    As a preliminary matter you ask the judge to prevent the WS from being presented at the hearing.

    If the deadline is today then you need to give until the end of day. (Or at least 4pm - check what the court order actually says ... it's usually something like "by 4pm on XX date each party must file with the court and serve on the other party any documentation upon which they will rely")

    So they're not actually late yet. And if it arrives tomorrow I can't see a judge being anal about it being late as you're not really at any disadvantage at 1 day late; but if it doesn't arrive until next week (or at all) then you should argue for their WS to be struck out.

    A final Public Consultation is coming.

    We need you; motorists need you to help us make a difference forever.  What a waste of your time this was, and why should there be such a litigation culture in parking?   It's truly horrible being pursued for £100 plus false 'fees' for no reason, by an ex-clamper aggressive firm, isn't it? 

    Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the court culture. 

    There will be one window of opportunity later this year.  My best guess is now November/December.

    Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

    The PPC money-grabbers have blocked the new Code by filing for Judicial Reviews.  Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

    It's on hold. Motorists urgently need it reinstated and the ban on false 'DRA fees' confirmed, to stop the rot.

    This will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.

    We need high numbers of real victims to make a point of responding to this final Consultation
