  • Well they have failed to state on the Particulars which of their Terms or Conditions you did not comply with. Therefore you can include the Chan case in your defence which should see their claim fail.

    Our case has been assigned to the small claims track now. Deadline for a witness statement is 4th July so there is ample time. I've seen several good example on here. We need to make a decision about whether to have a judgement made on the papers though. If it was me I'd be happy enough with an in person hearing, however I've been doing the donkey work for my wife thus far and with a hearing she's the defendant. Is there a huge disadvantage to agreeing to a decision being made on the papers so long as the submission is well drafted?

    You do not want a hearing on papers because you will probably lose if you do. You must object to such a hearing and explain why you want an in person hearing. 

    Please show us the draft WS before you submit it, and please show us the claimant's WS when you receive it. Make sure you redact personal information.

    Yes. She'll lose and risk higher costs, too.

    Following submission of my defense I did receive a communication from CST law back in Feb including pictures of all the signs on site, a redacted copy of their contract and a more detailed description of their case. I've attached the latter - I'm not sure if this now makes the initial complaint about a non specific claim redundant? It gives me a feel for their likely witness statement in any case
