'Overstay' in gym car park

If this car park is the Gyms and only the Gym then the front of house staff are either ill informed or ( and) are lying to you.As principal they are jointly and severally liable for the acitons of thier agents, in this case met parking .Whatever contract the Gym may have with it agents, met parking is of no consequence to you - the buck stops with the gym and it is the gym who will be liable should its agents - an un regulated parking comany be upto no good , and the same goes for any GDPR breaches that may occur - GDPR is an interesting one as it adds in something called personal liability, for example the person in charge of the site / gym coud be held personaly liable for any GDPR breaches by Met parking .I would get in touch with the Gym and ask them to re consider - should this proceed to court then you could also ask Gym staff to attend the court. And for good measure and in te interest of openess , inform the Gym of this thread copy and past this link into your next correspondance

OP
I'd not waste my time as the rules are clear.
I'd be shocked if they caved in.
However, good luck if you get away with it.0 -

Please read some more threads and see what this is really all about, because we know what we are doing and the rules in private parking car parks are almost never clear. Even if they are, we win 99% of cases and I was personally involved in cementing the new Code of Practice released by the Govt in February to regulate what they called a 'rogue industry'. I was on the Steering Group that created the changes. This is a board of experts in this field.
You are presuming that the OP is the one 'getting away with it'.
OTHER WAY ROUND...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The way I read it that the 4 hours was per car and not per person. Now, if the OP
wants to waste their time, they are free to do that. I only shared my opinion just like everyone else and nothing more or less for that matter.0 -
The way I read it that the 4 hours was per car and not per person. NowThe signage says 'This car park is for the use of Virgin Active members whilst on the premises only. Maximum stay is 4 hours' - nothing there 'per car'. Did either member exceed 4 hours maximum stay? The way you must read it is in the context of the rule of Contra Proferentem. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Forget talking to reception you may as well talk to a P.T....Talk to the gym manager and only the gym manager.....Virgin Active gym managers are generally around the gym most weekdays but possibly not weekends although normally they have a number or e-mail to contact them directly. This is the only person in the gym you should talk to. Forget the co-ordinator, pool manager, reception team leader etc..... The manager wont have the power to overule but they will have a lot leverage with the parking company whether they admit to it or not.

The "admin fees" are unlaeful and a judge will surly disallow them. Have you complained to your MP? IMO the sign is too wordy and pribably too high to reae the small print anyway, read this,

Then once again you are completely wrong I don't even think you have grasped even the basics of this!
