  • Another small update. I received a letter today from QDR Solicitors saying 'Please note our intention to proceed with this claim'. I had half expected (hoped) they would drop this.

  • Another update: I got a 'Notice of Proposed Allocation to the Small Claims Track' letter/form today with a N180 questionnaire. I'm not sure of the best answers to put on the form for section A, C and D. Can anyone help?

    And if you have the new questions that's covered a month ago in a thread about it by @Grizebeck

    Don't disappear now for months please!  As per the link I gave you in my last reply, there is more to be done.

    We need you to be here. We worry people might drift away from the forum during the lull in their battle, and will miss the REAL war. The chance to change everything.

    All this court claim harassment and adding a false 'DRA fee' layer that was never incurred, is partly a way to gaslight and intimidate people into paying more, and partly it funds the 'race to court' roboclaim culture.

    Both of which must end.

    And that's what we want you to tell the Government. As we will (again...this will be the 3rd and final Public Consultation)!

    Read it if you didn't know the Govt very nearly got a statutory ban on DRA +£70 extortion over the line, and lower parking charge levels, but the moneymen have temporarily blocked it last month, and threw their toys out the pram.

    We need high numbers of genuine victim respondents to unblock it again.

  • Update: I received a "General Form of Judgment or Order" which seems to be referring to the parking/debt company because it begins:

    "The Claimant, you have been sent Notice of Proposed Allocation to Track"

    and then goes on to say that the claimant must file the Directions Questionnaire on or before 7 days from service of the order and if they don't the claim with be struck out.

    Is this a glimmer of hope or do these parking/debt companies usually leave things until the last moment?

    A slight glimmer possibly, but more likely the latter rather than the former. It won't be the 'debt company' involved, it will be the PPC's solicitors responsible for filing the DQ. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Unfortunately you were right @Umkomaas, I received a copy of the "Claimants Directions Questionnaire" today from the solicitor indicating their intention and obviously not drop the case. 

    Now to look forward to the chore of the witness statement (when required to do this bit).

    Start on the WS and exhibits now. Get photos of the site and signage in readiness. See if Google Streetview has anything useful.

    Safety first check ...... you have completed and sent your DQ to the CCBC and the Claimant's solicitors, yes?
