With regards to this should I contact Gladstone’s and point out that the additional £70 fee is banned etc. And that their original letter is vague and has no information on other than a cost and the vrm as I have seen this in the thread from 2017 called LBCCC fight back guidance. I believe the 30 days hold request is still running with Gladstone’s. also would it be worthwhile doing a SAR with Gladstone’s?I j don’t want to be reading old out of date threads and getting myself caught in a loop of thread hopping.

The guide to court by bargepole in the second post of the sticky Announcement for NEWBIES is what you should be following.
The fake add on £70 is covered in the defence template in one of the other sticky Announcements that you will be using when you get the court claim.
The SAR goes to the PPC.I married my cousin. I had to...I don't have a sister.

But I provide links to posts by others. Look again at the section in red capitals about knowing what happens when, which is in red capitals for good reason!I have seen this in the thread from 2017 called LBCCC fight back guidanceNo-one is meant to read that. It is so out of date it's never one to read. Stop. Get rid of it, if you bookmarked that old stuff. That is not an Announcement thread so it's out of date.
Why not just read half a dozen other (current) 2022 threads about Gladstones LBC stage? I've advised several people in April how to word a robust response about the DLUHC costs ban and the lack of integrity of roboclaim firms who keep spuriously adding it anyway.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, that's the correct thread. The second post of that thread contains a link to the guide to court written by bargepole.
The template defence in the sticky Announcements has a 12 step check list in it to follow, should you receive a claim.
Did you send the SAR to the PPC as advised back in April? If so, what did it contain (NTK or NTH)?
Did you send the 30 day hold instruction as near to the 30 day deadline you were given in the LBC? If so, did you tell them this was a hire/lease vehicle? If so, did you get a response? If so, what did it say?I married my cousin. I had to...I don't have a sister.

The pcn was issued to your vehicle because the driver parked in a manor whereby they become liable for a parking charge. With the time and date. Then it says the driver is bound by the t&c’s and liable to pay a charge if the conditions are breached. They contacted the dvla for the registered keepers details ( I was never the registered keeper as it was CBS through VAG) so this may be the 10 day difference in offence date and issue date
I didn’t include it was a lease car when I responded to Gladstone’s on their portal.0 -
Here is the letter.

Why ever not? Do it now, before the claim form arrives, if it isn't already too late.

Ok should I send them a separate email saying as such. As I can’t do anything else in their portal other than pay in full or make a payment arraignment.Fruitcake said:RogerTheBear said:

Send an email to the DPO of the PPC stating that this was a hire/lease vehicle but they have failed to send you a copy of the Notice to Hirer and therefore you cannot be held liable as they have failed to comply with the strict requirements of the PoFA 2012 and cannot therefore hold you liable for the charge.
Give them seven days to respond with a copy and tell them you will report them to the ICO if they fail to do so, and instruct them to cease proceedings.
Again, include proof of ID as you did before, include the PCN number and any other reference number.
Copy Gladstones in as well.
Send it to any other email addresses you can find for them as well, and also send it to yourself.
Separately, send an email to Gladstones telling them this was a hire/lease vehicle but their client has failed to provide you with a copy of the NTH and therefore you cannot be held liable as they have failed to comply with the strict requirements of the PoFA 2012. As a result, they should inform their client and advise them to cease proceedings immediately.
Do not under any circumstances reveal the driver's identity.
