Apcoa at Heathrow pcn

On 30/12/21 we dropped passengers at Heathrow Terminal 2.  Towards the end of March we received a pcn from apcoa. 

We picked up at the same terminal a few days before and paid to wait. But don’t remember seeing any prompts for drop off. For the sake of a fiver we would have paid.  Btw most of us had been suffering from Covid at this time and this is documented but not a defence. 

Anyway. We were surprised to see a pcn after so long. The drop off had been completely forgotten about. Isn’t there a time limit for getting these?

any advice would be welcome. We will pay the £40 (hope it’s still £40) if necessary. Thanks

    There are dozens of very recent threads about APCOA/Heathrow drop offs. They all say the same thing - appeal using the blue text initial appeal from the NEWBIES FAQ Announcement, first post, with an additional line to state that as the Protection of Freedoms Act 2012 (Schedule 4) doesn't apply at Heathrow, there is no keeper liability. APCOA will cancel. 

    Just read all the other threads on this location and you'll soon get the hang of getting this cancelled. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Thanks all. I’m using my phone so it’s very difficult to read or follow threads. I will take a look on laptop and come back if still confused. 

    My first post was trying to find out whether they had to send the pcn within 56 days or something but they sent it after 76 days. Thanks

    They can send an NTK any time they like. It doesn't matter, it will be non PoFA compliant and incapable of holding the keeper liable, and will be easy to beat as long as you follow the advice you have been given.

    We know.  But it doesn't matter.

    A non-POFA NTK (APCOA choose to never use that law) is incapable of holding a keeper liable, regardless of dates.

    Definitely recommend using the blue text from the Newbies thread. 

    I recently had an APCOA PCN cancelled at first stage appeal using the text provided, it was issued at an airport for non designated drop off.
