Ok so we want to appeal this

we have received a PCN from Parkingeye should we post pictures of it

Also should we post pics of the Car park for the signs they seem a wee bit complicated, there were no signs upon entering the capark that indicated ANPR cameras were in use.

Where the vehicle was parked there were no signs visible, this took place at night around half  6 in torrential rain if it helps any though the driver did say they waited in the car till it had slowed down raining a bit.

Read the NEWBIES thread first and tell us if it is a non POFA 'golden ticket' (which you need to read the Announcement thread to know what we mean).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That looks somewhat like a Scottish phrase. Are you (or the parking event) based in Scotland?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ha Ha no unfortunately ;-) this is Barnsley centre I have read enough of the newbies section now to know if i was resident in Scotland what the letter of reply would be. I just fount the signs a wee bit complicated to comprehend they seem to flit between statements and the actual bit you would agree to is in tiny wee writing.

I am working my way through this, It's from a company called Parkingeye , from what I have read has the POFA thing on the back. Already put an appeal in (no driver admission) , my expectation is that will be rejected and then at least we can get to being given a POPLA number?

We actually revisited the place in the dry and daylight and there is actually one sign on entry to the car park which isn't actually at the entrance and not even visible from the drivers position when driving the car into the car park.

Getting out of the car to go and read the sign directs you to read the signs inside the car park , which is pretty tough to do they are up in the air you cannot make the text?

Absolutely no signage upon entry to the car park stating its ANPR and the remaining signs are dotted around the perimeter 4 out of 6 are hidden or obscured.

Get pics of the site and signage in similar light conditions (without flash) as that of the alleged event ready for PoPLA. If possible take them in similar weather conditions as well.
Make sure you show how easy it would be for a motorist to miss the signs.

What happened when the keeper complained to the landowner?

handily they left the old defunct ticket machine up to make you think the car park is devoid of a ticket machine, its tucked away behind the yellow barriers

We are still trying to find out who the landowner is , Previously Barnsley council Rented this car park and it has pretty much been unused for the past 3 or 4 years by them in any pay and display capacity , I have been looking for the planning application this morning for all this work and there is nothing on the BMBC portal, that ANPR camera is on a new pole and the Ticket machine is new from 2022
