    Thinking about your Witness Statement wouldn't be time wasted either.
    Thanks. Yeah I have been looking to prep that, based on info in newbies section. Evidence I have photos and stuff showing the signs from different angles, and how they cannot be read etc.

    The Committee invites evidence on:

    • What the current level of delay in the County Court is

    • The ways in which the County Court engages with litigants in person, and how this could be improved

    • The causes of action giving rise to claims in the County Court

    • What future reforms to the County Court should be considered.


    Please also state that private parking firms and their bulk litigators are the main cause of delays as far as small claims are concerned.  Over a quarter of all small claims nowadays are private parking scumbags.  That is ludicrous.

    The MoJ must now be informed to urgently separate parking cases with a new pre-action protocol (requiring use of ADR instead of inflated debt demands and bulk litigators who want court). It should be a last resort but it isn't.

    Tell the Committee about your claim and show the Claim Form and the lack of evidence from the Claimant, who made no real attempt to narrow the issues and resolve the dispute out of court.  This treatment of motorists should be illegal.

    The 'debt claims pre-action protocol' is not fit for purpose for these cases.

    Please strongly OBJECT to the intrusive 'Debt Reply Forms' you were sent, and ask the Committee to insist on a proper ADR and 'private parking protocol' to resolve disputes and expose the worst scam PCNs out of court.

    Please add your voice; just 
    answer the questions in your own words but making the points above.

    You might want to also say the court communications are in legalese and unsuited to average consumer defendants who have not made an active choice to face litigation, but are treated as cash-cow victims by the out of control parking industry.

    by the way, I got this text in the auto-response, so wondering if I need to phone the court or send the form back in post too? Although it does say it is confirmation of receipt, so I can prove I sent it within the timeframes

We understand the delays that you are currently experiencing can be frustrating and fall short of the standards you rightly expect of us. As a public service, we record all complaints and regularly review points that are raised to improve our service.

     

    This service is currently undergoing a significant transition as we take on new work and expand to meet the growing needs of our customers. This means we have a large backlog of work to clear.

     

    The service is focusing on reducing the volume of work in priority order and to do this we are currently prioritising resources to tackle case progression work as opposed to dealing with chase up correspondence, so we ask for your continued patience and trust that your case will be dealt with in due course.  We are aiming to recover our position by the end of the September.

     

    The service has also recently introduced new procedures to make sure work is being processed as soon as possible. Please be assured that this is a result of feedback received from our customers, as we are actively looking to improve the service being offered.     Well, gathering my evidence together and so far, letter wise:

    3 original PCNs- -the only 3 I ever received, as found out about the other 5 in their appeal rejection!

    Sept 21 - nov 21
    Ocean parking -  8 letters received, demanding £100 per "charge"
    Plus appeal rejection

    Oct 21 - Sept 23
    38 letters from Debt Recovery Plus demanding £160 per charge (note this period started whilst still receiving Ocean Parking letters demanding £100 - confusing much?)

    2022 june to nov 23
    9 letters CST Law (more stored elsewhere so still to increase). 

    Letter before claim june 22.

    Last letter Feb 23, until:

    Letter before claim 23 november 23 which has turned into court claim.


    If that isn't harrassment, not sure what is!

    Wow... utter harassment.  Trouble is the Inquiry only accepts a word doc of a smallish size.

    Maybe post pictures of all the letters in order (data redacted) on lots of replies on this thread over the weekend, while watching TV, and then give the Inquiry a URL to this thread so they can see the images and just do one line as your answer about how many letters are in the link and how harassing it has been at pre-action phase at the hands of a rogue industry the DLUHC has promised to curb, not enable as the MoJ MCOL system does.
