    Particulars of Claim

    1. The Defendant (D) is indebted to the Claimant (C) for a Parking Charges) issued to vehicle

    1. The PCN(s) were issued on 24/12/2021
    2. The defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason:Minimum Charge Not Paid/ Overstayed The Maximum Time Paid.
    3. In the alternative the defendant is pursued as the keeper pursuant to POFA 2012, Schedule4.

    AND THE CLAIMANT CLAIMS

    1. £170 being the total of the PCN(s) and damages.

    With a Claim Issue Date of 24th September, you have until Monday 14th October to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 28th October 2024 to file a Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Login to MCOL and do the AOS online, following the advice in the newbies sticky thread, second post, do not touch anything else on MCOL, only the AOS acknowledgment, to give you more time to compile the defence draft 

    Change the thread title in the first post to mention court claim from the CNBC, or similar, because the current thread title is irrelevant

    Thanks- ive done my AOS online yesterday. Do I need to send my draft my a certain date?

    Thanks Keith. I did my AOS yday. I’ve followed the thread and used the template changing and adding bits. I need to include the dark conditions and how the sign was not illuminated to make it clear it was even a private parking space as I assumed it was street parking (even though I wasn’t parked and I was in the car at all times waiting for a space to open up). So I send this defence at the earliest convenience? Is there anything I need to add to help my argument. I’ve moved away from that location so it isn’t as easy to take pictures in the dark and no idea if there’s been changes since 2021.

    Draft your defence but do not send it until it's been checked and approved, preferably towards the end of October 

    Remember that its a concise defence, not a witness statement 

    Any exhibits and elaborations to bolster the defence are submitted next year, in several months time, in your WS bundle to your local civil court, not to the CNBC in Northampton 

    Remember that you are only adapting and showing us the first few paragraphs, not the rest of the template

    Okay thanks! Is the date 
    4pm on Monday 28th October 2024 to file a defence? The driver will get working on draft. Thanks.
