Received a Judgment for Claimant (in default) last week & need help

    @Coupon-mad there's a need for care here. The order as drawn says that the set aside application IS the defence, being good enough to defend the particulars.

    In practice what seems likely is that the claimant will now expand on that in a Reply or their statement. So all that is likely to be required is a statement. 
    So do I need to do anything before the date in April they’ve given ? I have no witness , photos anything , just my basic defence that the machine in the Highview car park was faulty & when I can’t remember every detail at the time

    If you look again at @Johnersh's post here 27 March at 1:22PM <<<<<<LINK, he is suggesting a statement (presumably witness statement) is required.  It is not dependant upon you having any witnesses, as you are the witness and you are just backing up and supporting your already filed defence (as part of your set-aside application).

    Yes, I am having the same problem. Thought it was my computer ! MSE software, it would seem

    It's a long-standing issue - see the Site Feedback board.

    Easily worked around by pressing Enter at the end of the line. :)

  • A question please re Notice of Allocation to the small claims track, in note 1 it mentions The Claimant do by 6th April file and serve a reply to defence. The reply should include information as to why for hire charges is consequential upon the accident and how the amount of the hire charges is not already in the claim form 

    This is incorrect and dont know how they got this information? 
    The claim is re a parking ticket, do I need to ring the court before I put in my witness statement?
    And when I put in my witness statement(I've got until the 16th) do I just put it on a plain piece of paper or is there a form?
