Help needed please, is there anything I can do with this pcn? Issued on 11/02/22 but photo has 12/02/22 date on it? Tia

    I can't read the date on the photos, but if they are indeed dated the day after the date the PCN was issued, you should complain to:

    The landowner
    The PPC
    The IPC 
    The DVLA
    Your MP
    Because a data breach has occurred, and data has been falsified.

    You should also complain to The Doctor, a-cause someone has nicked their TARDIS.

    Good. Go with my suggestions. 

    If a cancellation is not forthcoming by the appeal deadline, then send the appeal template in blue from the sticky Announcement for NEWBIES.
    Send it unaltered from the NEWBIES, except add a one liner that the PCN was issued before the date of the alleged event, therefore the photo evidence provided by the PPC is at best, incorrect, and at worst, has been deliberately altered.

    Once you have received a response from the PPC, irrespective whether the charge has been cancelled, please complain to the ICO that the keeper's data was unlawfully obtained and processed.
    Please also complain to the ICO, once the DVLA have responded, or not, that they, the DVLA, unlawfully sold the keeper's data to the PPC.

    Thanks Fruitcake, much appreciated. So just to be clear, I'm to send the blue appeal template to CPMS with the added one liner as you suggest, should I let them know I will be reporting them to the ICO with regard to the data breach?

    You can't report anyone to the ICO until you have complained to them first. Yes you can warn the PPC and the DVLA that you intend to report them to the ICO in your complaints. Note that the complaints are completely independent of any appeal you may decide to make. 

    This is why you need to first complain to,

    The landowner
    The PPC
    The IPC 
    The DVLA
    Your MP

    If you don't get a cancellation by around day 18 - 19, then you appeal to the PPC before the 21 day appeal deadline.

    Once you get a response from the PPC and the DVLA about your complaints (this has nothing to do with your appeal), than you can report them to the ICO.

    Complaints to the DVLA should go to: -

    ccrt@dvla.gov.uk 

    and

    KADOEservice.support@dvla.gov.uk


    You are complaining about the PCN being issued the day before the photos were taken, which is an impossibility. The PCN contains false data therefore the NTK should never have been issued.

    UKPC were caught doctoring time stamps on their photo' evidence and were temporarily banned from obtaining keeper data from the DVLA, so you want the DVLA to investigate this PPC and this PCN to determine whether the date stamps on the images of your vehicle have been doctored as well.

    Thanks pal, you clearly know your stuff and it is greatly appreciated. Quick question, can the PPC simply issue another NTK with the correct date on, the 12th?

    They can, but you will still have the the original PCN so you will still have proof the dates were incorrect, even if they issue a new PCN with a different number.

    Again, get your complaints in to all parties before the PPC realise they have mad a coq-au-vin up.

    I have made a few suggestions below. The complaint should go to the DPO of the PPC. Their contact details should be on their website somewhere.

    COMPLAINT

    With regards to the above PCN issued on the 11/02/2022, I wish to make a complaint for the serious data breach that has occurred here. This notice was issued on the 11/02/2022, with photographic evidence taken on the 12/02/2022, making this alleged offence event an impossibility.
    For the avoidance of doubt, the Notice to Keeper was issued the day before that of the alleged event shown on your photographic images.

    The PCN contains false data and the Notice to Keeper should never have been issued. I therefore require the parking charge to be cancelled within seven days. 
    As the registered keeper, my details have been unlawfully obtained and processed, and as a result I will be making an additional complaint to the landowner, your trade association, my MP, the DVLA, and the ICO in due course.

    I await your reply to this serious matter.

    Please do make all the complaints. It is the only way anything will ever get done about this unregulated industry referred to as rogues, scammers, and bloodsuckers by our MPs across all parties.
    The MP complaint is especially important because the proposed new mandatory parking code of practice has been published by the department for levelling up, and is currently with MPs from both houses for them to comment upon.
    Do mention UKPC being caught doctoring time stamps as you are concerned the same thing may have happened here.

    Just a warning, as you have already mentioned yourself, the PPC may try to re-issue the PCN. If that happens, you will need to fully understand the requirements of the PoFA 2012.

    Make sure the driver's identity is never revealed, not even in your complaints, although from your posts it looks like you are already up to speed with that.
